So you're arguing he's not competent for trial because of how dumb he is? You are gonna let him get away with murder? Why are you so happy that Tamir is dead? Cop lovers like you just make me sick.

Slanderer posted:Hmm yes you're right, I'm sure those lovely cops believed that they weren't legally justified when they pulled the trigger, you willfully dense piece of poo poo If they felt that they were legally justified in killing him, then why falsify the police report?

"feeling that your actions are legally justified" is an entirely subjective thing, and will obviously change. But them realized they hosed up after the fact doesn't retroactively change their belief that they were justified at the moment of the shooting. Whether or not they felt justified does not counter a murder charge, especially when you purposefully falsify police reports AND don't even bother to follow department procedure prior to the encounter anyways, unless it's always been department procedure to conduct drive by shootings.

Maybe you should look up the Ohio murder statute instead of reading the common law definition on Wikipedia?

Dead Reckoning posted:Actually, if they reasonably believed that their conduct was lawful, it seems like that would invalidate the "malice aforethought" element you bolded in your quote, because the guy who pulled the trigger would not be intending to kill someone unlawfully. Whether or not they followed department procedure isn't directly material to the lawfulness of their actions. Yeah, I'm not buying this argument for one moment. Belief that they were at risk of immediate harm does not support their method of engagement, actions, or the fact that they lied and falsified everything they could. Unless you are sincerely arguing that rolling up on a suspect and shooting them through the rolled down window without warning is a valid method of engaging one, you can stop trying to dress it up from a point of legality. The instant they chose that method to engage Tamir, they lost all legality.

These general law enforcement threads just aren't working out. As always, somebody can make a thread for the next incident that happens.
