I would appreciate any clarification from and .mil goons familiar with the process in TX.

It has to be a handgun qualification in the last year. You won't have to pay the fee for the license, but you will still have to attend the class in state and pay for that.

DPS will need the qualification info, a copy of your military ID, and a copy of your last earnings statement.

I was under the potentially misled impression that such a scenario could happen in a home defense shooting here in North Carolina but I do not have anything I can cite.

NC's laws on use of force and the house are totally hosed.

Basically the law is worded in a hilariously bad way which has had the consequence of only protecting your permitter, rather than the interior of your residence. As I recall it (check legal statutes yourself, etc. etc.) we have it on the books that anyone attempting to break into your home may be shot dead without warning. Pretty strong castle defense there.

BUT, once they're in there's this other law about how property owners or renters may only use "legally justified force" to remove people from their property. I forget why exactly it came about, but it has something to do with kicking out people you invited there. Basically it was intended to closed a perceived loophole where I could invite you to my place, shout "Castle doctrine, bitch!" and shoot you in my livingroom with no consequences - or something.

Anyways, as it stands now if someone actually breaks into your house you are right back at having to prove a reasonable fear for your safety or that of someone else - namely the exact same criteria for shooting someone anywhere else that isn't your house. In reality saying "well, I heard a loud crash, it was 4 in the morning, and I found this guy standing in my living room stealing my poo poo. He moved toward me and I feared for my life so I shot him" works pretty well as a justification for pulling the trigger.

They really, REALLY need to streamline the home-defense parts of NC law, but no one wants to touch it due to the political problems. If they try to strengthen it the Triangle will scream about Castle Doctrine being some kind of Texas "I shoot you if you come on my land" style license to murder, while if they attempted to weaken it the rest of the state would be up in arms.

It's the triangle made by Chapel Hill, Durham, and Raleigh in North Carolina. It's a huge research/academic area and is frequently also called the Research Triangle. There's a Research Triangle Park (RTP) that has facilities for a lot of corporate research, as well as a bunch of space rented out to academic institutions as well. Basically it's higher-level academia and scientific/engineering research central. It has the highest or 2nd highest per-capita rate of PhDs in the US, constantly trading slots with Silicone Valley.

As one can imagine, with all of the universities and egghead research types the politics tend to be somewhat to the left of good 'ol boys in the rest of the state.

When I was pulled over once, the officer disarmed me. I got everything back at the end of the traffic stop: my Glock 19, holster, empty mag and 15 rounds in a baggie. There should be 16 rounds though, as I carry +1. I check the chamber and yes, there's a round in it. I fail to see why the officer bothered to empty the mag when she left one in the chamber, so I'm going to assume she was a moron.

I've been pulled over once while carrying. (67 in a 55 - rural road with a sign I didn't see, thought it was still 65) I handed the officer my driver's and CCW licenses, he looked them over and after the usual "Do yo know why you were pulled over?" and explanation of the ticket, that was that. He never even asked me about the gun.

As a bonus he accidentally wrote the ticket to some poor random schmuck in San Antonio because he put the CCW number rather than the driver's license number into the computer. I didn't notice until days later, and when I told the clerk of court about it she contacted the officer and he dropped the ticket himself. Didn't even have to go to court.

It's complete horse poo poo. He spent fifteen minutes in his car talking into his radio. He then didn't mention it again. There's also the whole part about how if you have a reason to believe the intruder is "going to commit a felonly inside the residence", deadly force is authorized:

quote:

(a) A lawful occupant within a home or other place of residence is justified in using any degree of force that the occupant reasonably believes is necessary, including deadly force, against an intruder to prevent a forcible entry into the home or residence or to terminate the intruder's unlawful entry (i) if the occupant reasonably apprehends that the intruder may kill or inflict serious bodily harm to the occupant or others in the home or residence, or (ii) if the occupant reasonably believes that the intruder intends to commit a felony in the home or residence.

(b) A lawful occupant within a home or other place of residence does not have a duty to retreat from an intruder in the circumstances described in this section

I just got my CCH permit in NC this month, having previously held a LTC in Massachusetts. Taking the class, I couldn't believe how confusing the law is written. It was explained to me by my instructor that the part about being able to resist unlawful entry (ex: firing through the door) wasn't in the original laws passed in 1996 when the state began issuing CCH permits. The part about resisting entry was added to the law after a court ruling involving forced entry convinced lawmakers that the law needed to be tweaked. Do you know anything about this?

Everything about that incident is pretty bizarre, but getting swept with a loaded pistol that the officer is obviously uncomfortable with is pretty bad. That's the kind of poo poo that would make me call a range outing to a close at least. The frustrating thing is that it takes no more than 60 seconds to test for the problem, and I explained that in both of the notes that I included when sending the gun back. Literally within a minute of opening the box I was able to see that it wasn't fixed properly. I still confirmed it with a live fire test, which was even less successful than the dry fire test.

Yeah, I'm going to court with this to try and get it dismissed. There is a reason that I have been driving for ten years and never even been pulled over before. I'm Captain Caution in the car and this guy got me for a violation that is just his word vs. mine. I'm more banking on the fact that he will not show up being that our city is large and underwater. I know his word probably trumps mine regardless of driving record.

Another funny fact about my experience. He told me to SLOWLY produce the gun from my pocket. I did so. It is a Kel Tec P3AT in a Desantis Nemesis. I was holding it saying, "Here is the firearm, officer." He kept asking, "Where is it?! Where is the gun?" I had to point with my other hand to the only thing I was holding in my right hand, the firearm in the holster. He stared for a minute and asked for it and clearly had no idea what the gently caress he was looking at. Then came the, "Is it loaded?" "Yes officer with a round chambered." "That's not legal!" talk.

And I'm more than likely out over $130 bucks due to this lovely exchange.

Standard: Clips over the belt, visible from the outside
C-Clip: Hooks under the belt, less visible from the outside
V-Clip: Needs a belt with velcro on the inside, bonus is it's nearly invisible from the outside.

Unless you plan on wearing it tucked all the time, I'd just go with the standard.

I have a situation that can't be completely unique, but no one I know has been able to help me out. Over the past several months I've really gotten in cycling. I especially enjoy the Monon Trail that runs through most of the north side of Indianapolis.

However, it runs through some pretty sketchy parts of town. A number of times now I've found myself riding along on a $500 bicycle, with a $400 cell phone and $150 iPod, and realized that there was no one else in sight. Obviously, I would feel more comfortable if I were carrying like usual.

My question, what clever CC methods or tech are available for a guy in this situation? I usually wear lycra shorts or pants and a lycra shirt with a t-shirt over that. How does a guy in this situation discreetly carry?
