That's actually not illegal if she buys it for him as a bona fide gift. Intrafamiliar transfers between parent and child aren't subject to the handgun roster requirements, even if it's out-of-state (still need to go via an FFL, though).

Meh. The law is simple enough. Make sure it's not on the roster and ship to the CA buyer's FFL. If it's not on the roster, absolutely nothing happens to the seller. The buyer is just out of luck as he can't take possession. All he can do is hope his FFL can sell it on consignment for him.

I'd wager the main reason people don't ship to California is because of 1) sheer laziness, 2) drinking the Beck/O'Reilly/Limbaugh Kool-aid and thinking they're somehow striking a blow for freedom , or 3) most likely a combination of 1) and 2).

Because "high capacity" magazines (i.e., magazines that are normal able to hold more than ten rounds) aren't allowed to be imported into California. The thing is that you can take the magazine apart and ship it as a rebuild kit. Sure, the end buyer can reassemble it and break the law upon doing so, but that's on his head.

This is an area where the shipper *can* get in trouble for shipping the (not disassembled) high capacity magazine. Sure, you'd be breaking California law rather than federal, thus would have to be extradited or appear on your own initiative to face the music in court, but still, it's a felony and that's never good to have on your record (in the admittedly unlikely event you're found out).

I did that for my XD45, though I listed more than one gun I'd be willing to trade for. That's how I scored my (off-roster) 586. But I did it because I didn't know how likely I'd be to find a 586, the XD was my only handgun at the time, and I was fine keeping it unless I got what I wanted in exchange.
