I was recently charged $25 by my apartment complex for throwing a bag of trash on top of the big trash container instead of putting it in the drawer you're supposed to. My question is, is it legal for the apartment people to open our trash and dig through it? I'd like to not have to pay $25.

yes trash is public property, however they probably didnt dig through it, a staff member probably saw you do it. But ask how did they know it was you, demand proof.

The complex can dig through your trash all they want. There's no reasonable expectation of privacy with stuff you throw away (from private parties or the cops). In the future, you can always just use your trashcan as a toilet. That way, even if there's something in there indicating whose apartment it's from, the management won't bother to dig through it!

You should definitely call your management company, and tell them that you are planning legal action against them for the violation of your trash-privacy rights, as enumerated in the constitution.

You should go through other people's trash and collect identifying info, then include it in your trash and throw the bag wherever you want. Then the management will go through the bag and go nuts trying to figure out whose bag it really is! It'll be hilarious. Also put a riddle in the trash. Apartment managers love riddles.

I am that guy that has to pick up that trash. If I find some garbage that was not thrown in the compactor and it's clearly a specific resident (seriously that junk mail you threw away has your name and address on it) I usually take it back the people's apartment and act like it's a bike and they must have misplaced it. Making people take trash out twice is more effective that charging them money in my opinion. EDIT: A good way to be sure that they don't go through your trash is to actually throw it away. In a court of law, they could maybe argue that it wasn't trash because it wasn't placed in the trash receptacle. It was almost as if you just left the trash in any other common area.

At the complex I live in there is no assigned parking unless you pay for it, so if there aren't spots available directly in front of the building I live in, people started double parking, parking in the fire lane, and parking in handicapped spots. There are plenty of spots, people just didn't want to walk an extra 50 feet to them. So I started calling the police. That stopped pretty quick. Cost of assigned parking in a carport? $40/month Cost of assigned parking in a garage? $60/month Cost of being a douche and parking wherever the hell you want? $150/night You sir, paid the douche tax. You don't have a case as it's well within reason that they can do whatever the hell they want as stated in the lease that you signed. Worse, is that these complexes often have legal teams and will challenge you without hesitation. Your BEST bet is to go to the office and kindly explain that you made a mistake and if they could, this one time, waive the fee. Anything else is going to either cost you or make you look stupid.
