Walking away from a project as lead artist and pulling all the assets you've made is just so monumentally hosed it's on another level, though. Especially given the amount of compensation he was already receiving.

Again, though, that contract could have allowed him to do that after the game was released. His exclusive rights were maintained for all work.

This poo poo is why my local game dev group has constant advice from speakers that lead with "get the legal poo poo sorted out first" and "get a lawyer, we know a good one who specialises in this stuff." This right here.

My money's on him asking for that to be included and the other guy putting it in because he's a fuckin' moron who doesn't look up words.

What it boils down to is S-Purp saying "Well, the money's in a better place with me, because I'm gonna finish a game, those other guys wouldn't have finished their game." And then, conveniently, he walks away with the money and assets to make that a self-fulfilling prophecy. Pretty slick self-justification, that.

LOL. The "we only realized at the last minute that the game couldn't ship" is hogwash, I'm guessing the actual thing was "QA has been screaming about how unfun/buggy the game was for months and I guess we finally had to listen otherwise our Steam rating would be tanked forever."

Shantae is shipping in September (maybe), it will be nice to finally see an end to the projects I backed. Speaking of which, is there a reputable site to sell keys to games that I backed but realize I no longer want?

I was never actually under contract in any way, shape, or form while working on OutQuest. I don't necessarily know if that was a good or bad thing, but i got paid consistently and i got things done.
The other team members had contracts though, especially any other artists that worked under me as freelance workers. I guess I was an outlier for some reason.

What I'm saying is yeah that could absolutely have been the case. Most indie teams don't bother with contracts cuz it starts out as just some dudes making a thing, which is exactly how things started with me.

I dunno, something about this PftG thing seems really suspect. They HAVE to have outside funding or something.

Then again, it says only 5 bosses, so... it's basically a quarter of the game SotC was? I'm now expecting a pretty small world with about 3-4 hours worth of boss fighting content. Not a lot, but hey, it'll be pretty?

Did you know you can run a Kickstarter campaign without having the project 100% done ahead of time? It turns out you can use the kickstarter money to pay for getting your project done, like by hiring writers!

It is parody, it's an exaggeration of the seal and people do it all the time.

But while I haven't overlaid the images it looks like the seal he was doing was literally the Nintendo seal with different text in which case it toes that line between parody and trademark infringement. Everybody else does some variation with the triangle-circle thing.

The UK's somewhat recent legislation doesn't define parody, but I can't be assed to find case law.

Regardless, though, the UK's law applies to copyright and not, as OP referenced, trademark rights.

"Appropriation" is the heart of parody. "distorted imitation" specifically. How distorted is what the long history of infringement cases fight over.

Making a spiky gold seal with "licensed by..." With the intent of mimicking the Nintendo seal is parody.

I couldn't remember what his original image looked like, so I went with "parody" to be safe since most of the other words I could think of at the time came with some negative connotations.

After digging through my emails I did finally find an image with his seal, and I agree that his version was really pushing it.
