remember how the E/N trans thread had some idiot trying to portray a sexual predator who repeatedly raped their preteen son and then hung themselves in prison because the government woudn't pay for sex change surgery as a martyr to the cause of gay/lesbian/etc rights?

that was funny and extremely embarrassing

Karma Monkey posted:

So, I'm back from FCI Petersburg. Because my gf had emailed me a bunch of articles to post about Ashley's suicide and the (mis)treatment of transgender prisoners there, the prison revoked her email privileges, and also threatened to revoke her other communication privileges if she communicated anything else that might compromise their investigations. It's retaliation, and we expected they would get ugly about things, so it's not surprising, but still infuriating. To cut her off from being able to communicate with family and loved ones right after she lost her best friend is just cruel, and I really hope they lift the ban soon.

Anyway, while at the visit I got to hear about the incidents that led up to Ashley's suicide including some physical harassment by one staff member who is supposedly being investigated now. The prison said they would "deal with" the corrections officer, but his punishment will most likely be a transfer to the low security prison for a few months and then he'll be back. I doubt any of the other staff who harassed her verbally will receive any reprimand. The only witnesses in those instances were prisoners and no one is going to listen to them seriously, at least not on an internal level.

I have a bunch of news items that were written up to be disseminated, but since they involve both ongoing investigations and lawsuit cases, I think I need to hold off on doing anything with them until the lawyers give the go ahead. It's possible they will end up being the ones to release the information since the prison can't threaten them about it.

I asked if there was anything we on the outside could do. Change.org came up, but I don't know. I've seen tons of petitions on there for transgender and prisoner rights, and I'm not sure how effective they've been. She said that writing to the VA rep Bobby Scott could be helpful as well as writing to the BOP Director Charles E. Samuels, Jr. and the Deputy Director L.C. Eichenlaub would get some attention. The warden could be contacted, but I doubt he gives a poo poo what anyone says to him if it isn't someone in his chain of command. She also thought that contacting CeCe McDonald's people, and activists like Laverne Cox and Janet Mock would be useful. I don't know.

I'm feeling a little paralyzed by everything right now. I need some more time to process it all. If anyone has any suggestions, I'd appreciate it. I can at least post this item. It's an interview of one of Ashley's friends and a photo of her, taken in the prison yard. Katie White is a pseudonym of one of the prisoners there. It's the only thing the prison didn't flag, so I'm using it.

-----------------------------------------
Laying Transgender Advocate Ashley Jean Arnold to Rest:
An Interview with Sangye Rinchen by Katie White

On February 24, 2015, Ashley Jean Arnold, a 32 year old transgender prisoner incarcerated at Federal Correctional Institution Petersburg Medium in Petersburg, Virginia chose to end her life amid a legal battle with the Federal Bureau of Prisons to provide her with adequate treatment for her gender dysphoria. This battle took her from filing grievances in her housing unit seeking treatment to filing a federal lawsuit (docket number E.D.V.A. 1:13cv900) against prison officials to a gurney with a plain, white sheet draped over it. It's a sickeningly tragic and easily preventable story; no one can deny that.

Today I talked to Sangye Rinchen, a fellow transgender woman at FCI Petersburg, who was Ashley's best friend and Buddhist lama, and who helped Ashley with her legal battle. We discussed the transgender woman Ashley was, what happens now, and what her life stood for.

Q) Obviously you're devastated and would rather be doing anything except talking about this. Why talk to me?

A) This is a story that needs to be told. Ashley's death will not be for nothing. Her story, I'm sure, will act as a lightning rod for redress for her death and protect other transgender people, inmates and not, in need.

Q) Bear with me here. Can you please share what you know about Ashley's final hour?

A) From what I know they were relatively peaceful. She hung out with a few of us in the art room, walked the track with a friend, ate lunch, and eventually made it back to her housing unit. During this time she seemed to be in good spirits.
In the afternoon of February 24, 2015, she was in her cell alone and put a noose around her neck and ended her life. Upon being found, medical staff rushed to the scene and tried to revive her. Emergency medical technicians were also called to the prison, but it was too late. She was wheeled out on a metal gurney with a white sheet draped over her body.

Q) You weren't in the housing unit at the time. How do you know all of this?

A) Some of this I was able to see and the rest I have been able to piece together from eyewitness accounts from those who were there. While the prison administrators probably won't share what occurred with outsiders or any applicable investigations into her death, I believe this to be an accurate accounting of events.

Q) Are you worried that FCI Petersburg prison officials might retaliate against you for sharing these details?

A) It does not matter. Ashley was my transgender sister. She was my best friend. We've both battled the administration in an effort to obtain treatment for ourselves and others.

Q) According to federal court filings (E.D.V.A. 1:13cv900), Ashley had repeatedly sought treatment for her gender dysphoria but was not satisfied with the treatment offered. Your thoughts?

A) It is my belief that the lack of timely and comprehensive treatment in Ashley's case contributed to her death. For years she sought meaningful treatment. She asked, then begged, and finally demanded it. FCI Petersburg prison officials knew that she desperately needed help, this is evident in her almost daily visits with her prison psychologist, but still refused to provide her with everything that she needed. That's why she filed grievances first, then the lawsuit.

Q) The district court judge, Leonie M. Brinkema, granted the defendants' motions for summary judgment and denying permission for Ashley to amend her complaint. What happened here?

A) The long and short of it is that the judge, in response to Special Assistant United States Attorney Benjamin T. Hickman's motions, decided that no Eighth Amendment violations had occurred and that prison officials weren't deliberately indifferent to Ashley's treatment needs, which the government described as not sufficiently serious to warrant constitutional protections.

Q) But she killed herself around 60 days after the ruling. It sounds like they got it wrong.

A) They did. Ashley needed treatment, plain and simple. While the judge and the government's attorneys didn't kill her, they also didn't stop prison officials from laying the groundwork -- a stubborn refusal to provide treatment in line with established medical standards -- that led to her death. She needed to feel that there was hope, and due in part to interactions with staff and the court, she appears to not have thought that there was any other way.

Q) The amended complaint, which was rejected by the court, alleged very specific and serious instances of harassment and retaliation against Ashley due to her transgender status. Care to elaborate?

A) Certain prison officials at FCI Petersburg clearly went after Ashley because of her transgender status. They wrote multiple false incident reports against her, went out of their way to harm her by filing false treatment notes in her Psychology Department file, and wielded male pronouns as weapons to cut and dismiss her gender identity. Others who weren't directly involved in the systematic sexual and gender harassment chose to not speak up and stop it, much less abide by the Prison Rape Elimination Act (PREA) and report it. In one instance, the prison's PREA Coordinator actually made some of the anti-transgender comments.

Q) What happens now? They don't just get away with it. Do they?

A) History says that they will, but that doesn't mean that we can't try to change that. Ashley's death should mean something. She wasn't asking for the world, just a little respect and some basic accommodations accorded to transgender women out there, you know? We'll try to make it different this time.

Q) What's the message in Ashley's life and death?

A) Ashley Jean Arnold was a brave, beautiful, proud transgender woman. Her light will continue to shine and her story will without a doubt result in changes to the world around us. Other trans women will be better protected due to her sacrifice. Her death will count for something. And for now, that is enough.
