If you're asking whether it's part of the scope of RICO as declared when it was introduced in congress as acting for "the elimination of the infiltration of organized crime and racketeering into legitimate organizations operating in interstate commerce," well, it's just utterly silly. Maybe I'm just being cynical but my hunch is that if they were white and affluent, the charges would be different and much less severe.
