The only possible reason Republicans in the Senate would have to move is that there are enough Republicans in vulnerable seats in 2016 that the total kneejerk opposition will be politically damaging enough to them to bring them around eventually. On the other hand, the Roberts court has so strongly embraced right-wing judicial activism, which is hugely important to a party establishment that knows it will never pass most of its agenda democratically, that Republicans will be absolutely loathe to give up control of the court.

I don't know what the executive plan is for trying to get this nomination through in less than a year...but if it were me, I'd be hammering the media every single day about how republicans are on purpose holding up a significant nomination solely because they hope to win the election. I know we won't get a progressive judge, but at least a moderate one would be a vast improvement over the court that gave us Citizens United.. Hopefully it can get done in time or Sanders/Clinton win the election..

Abbott completely and utterly loving Dems from winning another election for eternity, so that's something. The lower courts already sided against Evenwel, so if if the court splits 4-4 on it come June it'll defer to the lower court ruling.
