Nine is just convention because they need an odd number to break ties. 28 USC 1.1 The Supreme Court of the United States shall consist of a Chief Justice of the United States and eight associate justices, any six of whom shall constitute a quorum. FDR's court packing plan was to use democratic supermajorities in both houses to raise that number to 20+ so the 9 seated justices would be irrelevant.
