The only legal precedent possibly established is that broadcasting peoples genitals without consent isn't protected speech. Gawker tried to argue in court that it was journalism by sole virtue of the fact that internet randos were willing to click, which is the same justification used by revenge porn sites. I don't get why everyone is quick to defend Thiel and Hogan. Everything about Hogan's tape was a business decision. He wanted people to see it. I guess it's cool to support Thiel if you like Wurthering Heights-esque stories of revenge though. Also, you don't need to blur out the Hulksters sex tape because any human eyes are naturally going to fade out of focus when presented with that specific naked body.
