INTRODUCTION

On June 29th, 1846, Sir Robert Peel, Prime Minister of the United Kingdom, stepped from Buckingham Palace, having just tendered his resignation to the young Queen Victoria after losing a vote-of-no-confidence. Wracked with social unrest due to the repeal of the Corn Laws, the Irish Famine, and the Maynooth Grant controversy, Peel left the government in shambles. The naive and emotional British Empress furthered the discord in Britain when she attempted to reappoint William Lamb, a prominent Whig and favorite of the Queen, to the Prime Minister’s seat. The outcry by the extant Conservative majority in parliament brought the British government to a moment of crisis, with prominent voices (including Peel himself) calling for the appointment of Frederick FitzClarence, illegitimate son of William IV, to the kingship. With unrest gathering in Ireland, Victoria begged one man to pull himself above the fray, to support the monarchy and unify the nation by once more taking on the role of Prime Minister, this time in more than a caretaker position. Thus, Arthur Wellesley, 1st Duke of Wellington, ascended to the leadership of Great Britain at the age of 77. His first official act: British intervention to cut the United States of America down to size and unite the nation, for Queen and Country!


TIMELINE
1846 (Jul) - US invasion of Mexico is a disaster after Britain joins war on Mexico’s behalf. British expeditionary force cuts off US troops in Central Mexico.
1847 (Apr) - American forces withdraw from Mexico proper. British troops occupy Texas, which "votes" for secession from the Union. Texas is established as a British protectorate, immediately in conflict with the Mexican state due to its immense land claims to the edge of the Rocky Mountains.
1847 (Jun) - Britain forces the US to pay reparations to Mexico and Britain both. British reparations are given up in favor of total control of the Oregon Territory. A strong Whig government comes to power in Washington after riots depose Congress.
1847 (Nov) - American military forces occupying Alta California proclaim that they will hold the land until Congress authorizes payment of past wages. The new Whig Congress refuses to pay soldiers, due to both lack of funds and popular resentment of military. Mexican political chaos in Yucatan allows the American forces to establish themselves in a political vacuum.
1848 (Mar) - Gold is discovered in New Helvetia by members of the Mormon Brigade while hunting for deer.
1848 (Sep) - British government offers de facto recognition to American forces in control of California, with the Iron Duke proclaiming that he would not have California for the Americans, nor the Mexicans, nor the natives.
1849 (Apr) - Word has spread far and wide, and prospectors are flooding the region. Local military government is collapsing as soldiers are abandoning their posts to prospect. Mexico and America are making threats. Texas is suggesting confederation, with associated risks of British control and protection both. Prominent persons of California converge on Yerba Buena to formulate an official government.


RULES
Each player will PM or email their orders to FSAD. Actions are freeform, as in you can do whatever it is reasonable to imagine your character will do. Success will be decided somewhat randomly, and the chances of success will be subjective. The only control you will have over this are a number of points. Each player will receive 10 points per turn which they can apportion between their actions. The more points you apply to any action you do, the higher the chances of success.

Government: A Republic has been established. It is firmly set along American lines, and in almost every respect apes the American constitution.

Bureaucracy: Civilian government is nearly non-existent outside of San Francisco, Moroni and Nueva Helvetia, where it is entirely within the hands of a few elite. Wealthy local elites are in non-official control of Californio settlements. Few appointments are based entirely on nepotism and cronyism.
Land Ownership: Large Californio-controlled ranching estates under the Spanish/Mexican land grant system, this system is under immense strain as miners are ignoring Californios
Administrative Divisions: 6 states, large territorial claims. Most of the states are little more than lines on a map in San Francisco. Outside of the few areas of control, the government is non-existent.
Indian Administration: Missions along southwestern coast, unincorporated elsewhere
Education: Private, family-based except in San Francisco and Nueva Helvetia
Religion: Decrepit mission system broken by Mexican reforms for a generation. Californios are overwhelmingly Catholic, Anglos are overwhelmingly Protestant. Relatively large Mormon population in San Francisco and Moroni, while eastern Nimrod is experiencing a wave of Protestant Anglo immigration.
Stability: The country is overwhelmingly stable and settled after the recent declaration of Republic. The Californios of the south have been left alone, and the wide franchise and gold fever limits any social instability.

It's funny as the three basically most important characters haven't been chosen. I'd love to get some more people in for these guys before we start...

Kearny is a hardass military officer who in a way "stole" command of California from Stockton, the naval officer whose forces had actually secured most of California (Kearny and Stockton were of equivalent rank) long before Kearny arrived. Stockton put Fremont in charge of California, but Kearny clapped him in irons and in the original timeline, sent him back to the US and had him court martialed for insubordination. In this timeline, Kearny is in a much less secure position, and Fremont's California battalion along with his friends Kit Carson and Admiral Stockton might make it hard for him to keep Fremont imprisoned. Sutter was the guy whose settlement next to what would later be Sacramento allowed the Gold Rush to happen. He was a wild Swiss emigrant who set up basically his own kingdom in the central valley.

As the convention opens at Yerba Buena's ramshackle Niantic Hotel, more than a hundred of the most prominent and well-to-do Californios, Anglo settlers, American (or former American) military officers, European immigrants, and now even a few Asiatics of various sorts. An observer from the British Empire is present, though remaining relatively low-key, he insists firmly that he is only here to observe and report back to the British post in Oregon. While several Anglo military officers, especially those close to Frémont, have requested British recognition of the independent status of Alta California, the British have stated firmly that without any form of civilized government, it's quite impossible. No representatives from the Mexican government will deign to set foot in the convention hall, while the Americans have expressed complete disinterest apart from their desire to prosecute soldiers they consider to be AWOL for desertion, and have them shot should they return. A bearded Russian fur trader from the Humboldt Bay region walks among the convention attendees, seeking to learn and relay what he can to the Tsar's agents.

It is clear that the current state of affairs, the territory of California occupied by former American military officers, is not well constituted for the surge of immigration and wealth taking place with the discovery of gold in the foothills of the central valley. The Californios chafe at the end of their traditional privileges, while the new immigrant community, overwhelmingly western European and protestant, want nothing to do with Mexican tradition or law. It is clear that the first matter to take place and have a vote will be what form of government should be constituted. While California's claims in the east are all but unenforceable, the vast territory spreading east to the Rio Grande, and north to the Great Salt Lake, and everything inbetween, is far too sparsely settled to control at the moment. Some suggest abandoning that claim, and creating a republic composed of states along the American model. Many Californios say that California has always been one territory, and spurn ideas to give up or concentrate power. The immigrants see only the prospect of gold, and the possibility of greater riches in the vast, trackless desert.

OOC: I will present various possibilities for discussion here, consider it akin to a choose your own adventure storyline, with a bit more flexibility. Based on the decisions people make, some future decisions will be opened, while others will be closed off, so take that into consideration. In the end I will tabulate votes based on these characteristics: the influence of your character, how well you cooperate with other characters, and how well you argue for your position (or debate against other's positions) through forum posts. Players will post in this thread for a day or so and we'll consider the issue closed, then move on to the next issue, until it seems like most of the overwhelming issues of the constitutional convention are settled, then it'll open up to more freeform play. Try to keep some debate and discussion here rather than in chat rooms so people following can understand how things develop. As you debate, make it clear that you support one of these four choices in some OOC aside comment.

A. We are most of us here Americans, and America is a great nation! Let us recreate the Republic, a nation of states, clear separation of powers, and law!
B. A strong leader is what is needed to meld this disparate group of people together! Let us have a dictator, an emperor, some great man to rule us and make our nation strong!
C. We should look to the ancients, with a small population, let us have a truly popular democracy, one man one vote, akin to ancient Greece, and cut out the middleman of republican corruption!
D. American democracy is a failure, let us create a kingdom, along the lines of Europe, with a true monarchy... and seek alliance and support there!

By a clear acclamation of voices and speech throughout the convention hall, voices drown out any voices for anything but a republic. yet a few key voices discuss, what sort of Republic shall be crafted here? Who shall have the franchise?

A. The American system is best, let all white (Anglo) males have the franchise, whether they own property or not!

B. The American system has resulted in a degraded Jacksonian democracy rather than a true republic, let us restrict the franchise to white property-owners once again!

C. As the Roman system went, let us forge a Republic based on the prime example! Voting shall be done only by citizens, and citizenship should only be granted to those who meet certain criteria, not necessarily based on ethnicity or wealth, but also considering the possibilities of service to the state.

D. With such a mixture of peoples, the Latin American republics have great experience. Let people be classified by their degree of ethnicity, with those of greatest European descent rising to the top! We should have a Republic along the lines of Mexico!

E. As people march west, freedom marches forward! Let us expand the franchise as it has never been expanded before! Let all persons vote, regardless of race, religion or even sex!

F. The primary necessity of any system of representative government is that its citizens are animated by deep and sincere religious belief. Let us restrict the franchise to those who correctly worship the Lord God!

The announcement of the arrival of the Mormons has created quite a bit of discord within the convention. Many doubt that allowing them to settle along the passages to the gold fields is good, and much anti-Mormon feeling is rampant within the Anglo population, less so among the Californio population as they have little knowledge or experience with the Saints. "They're trying to hog all the gold fer themselves!" "They aint even Christians!" "It ain't God that's speaking to their prophets but Satan himself!" are common refrains at the Niantic. Attendees clamor for some kind of voice to decide how to deal with the issue of large-scale Mormon immigration...

OOC: I am using numbers rather than letters to prevent this from getting confused with the still-open issue of the franchise

1. The Mormons are looking to set up a nation where they're in complete control and they set themselves above all other men! They are free to live here, but their attempt to wrest control of the best farmland of the Valley or the passages to the gold fields is unacceptable. They had better evacuate from any nearby land completely (Mormons can exist in California but on the outskirts, far from the gold fields or San Francisco but not so far as Utah)

2. The Lord our God does not suffer a man to preach against his word. These Mormons should be put to the sword, each and every one of them, run out of California altogether! (Mormons will be killed or persecuted until they run away)

3. The Mormons are strange people, but their beliefs are not so different as those of the heathen Chinee or Indian, let them stay and make what they can of this land, and govern themselves according to their own rules, in their own communities. (Allow the Mormons to settle where they wish and live as they wish)

4. If the Mormons wish to live among us, they must do so under our rules, and our laws. They may not preach their doctrine to other men, nor can their petty theocracies ever trump the laws of our newborn Republic. There should be no consideration of Mormon towns, Mormon cities, Mormon states. (The Mormons can stay but they commit themselves to whatever civil law is to be established, and are not allowed to preach openly)

Giving any new players (we have 3) a chance to join in and post their opinions on franchise and Mormonism before tomorrow morning, then I will figure out who won the votes and introduce some new stuff. Once we have a few more of these votes, we'll move forward. Please take this as a chance to set up political groups, find people with similar or compatible goals who can work together with you, that kind of thing. Get to know people, talk, figure out what you want to do together! Once the game leaves the convention, it will get a lot more freeform in terms of what you want to do

Excited conversation takes place throughout the convention hall, arguments ringing from the rafters of the Niantic. The idea of a simple carbon copy of citizenship and the franchise as it exists in America is ruled out, a clear voice acclamation makes it known that the people overwhelmingly support an extended franchise! All people, all races, all sexes, the total extension of the franchise to every reasonable group seems to be moving forward!

As the discussion turns towards Mormonism, the voices of the representatives grow far more strident. Two clear camps emerge, one which would force the Mormons to abide by all laws of the state and prevent them from preaching, and another group which would give them the same freedoms to settle and preach as they wish. Calls for voice acclamation are unclear, neither side is particularly louder than the other. In the end, ballots must be cast... the camp casting for complete freedom for the Mormons winning by about 10% of the vote.

Thus the beginnings of the new Republic are forming! It shall be indeed, a Republic, based on laws and on the American model, but far more based upon individual freedoms and with a far wider franchise. The extension of freedom to the Mormons is seen as a keystone in the Republic's formation. That a group which is as widely feared and even reviled could be extended complete freedom of worship and settlement is seen as indicative of the character of the nascent nation. The details begin to be sorted out, and now it comes to the nuts and bolts of how to make decisions in this country. What sort of character it should have. How government should function. A Republic along American lines yes, but how is that to work? America with its tens of millions, spread across multiple states, while California with a bare few tens of thousands, spread across one giant state. The impossibility of creating a copy of the American senate instantly becomes clear, unless great changes are made. Just the coastal region of California occupies an area as large as that stretching from Boston to Georgia. Thus the discussion progresses...

How should we divide up the land of this nation, California?


A. The coast and near-interior should be split into a large number of states. Each state sovereign unto itself, each state with its own government, in control of its own destiny, with the federal government existing along the American model. Our Republic will consist of a Senate and Congress, representing variously these states and the people, again, as per the United States. (Divide California into a bunch of powerful states, starting with those closest to the coast where there is physical control, a senate represents those states individually, and a house of representatives represents the people, as in America)

B. California has never been divided before, and the idea of introducing artificial distinctions between the people of Los Angeles, San Diego, Monterey, San Francisco, and elsewhere is reprehensible. We do not need to parrot everything about the American government, let us have no senate, nothing but a single unicameral legislature, a Congress, elected directly by the people. We shall have administrative divisions of course, not states but provinces, and they will be directly responsible to the Federal legislature, along the lines of a nation like Republican France. (No powerful states, all provincial administration is directly controlled by the Federal government in a unicameral legislature, much more of a French system)

C. The divisions of the state should be consequential, with some powers delegated, but rather than allowing the states to have a say, we should represent the various classes within society. We should follow the British model, with a House of Lords, and a House of Commons. Let the House of Lords represent the wealthy and powerful in society, and have membership for life. Let the Commons represent the base citizenry. (A more British system of a Parliamentary republic, adjusted to live without a monarchy)

In addition, with the promotion of the discussion towards the widely expanded franchise, some questions have come up, and some concerns have been voiced.

1. The franchise should be open for all persons, regardless of age, race, religion or any other inconsequential division!

2. All men should have the vote, but women are far too emotional to be entrusted with such power.

3. All Christian men, of whatever form or character, should have the vote, but Mormons are not true Christians.

4. All Christian men should have the vote, including Mormons, who also worship the Christ!

5. The vote should go to all men, apart from those of Asian, Negro, or Indian extraction. At least the Latins have the blood of the Spanish, what would a Chinee or a Cherokee do with the vote?

OOC: A lot of people have been discussing conversion to Mormonism. While I will not stop anyone, I just want to make it clear that doing so will presumably result in large losses of influence if your influence comes not from wealth. Influence represents your ability to get things done, much of which comes from your ability to convince others to follow you. Right now, several Mormons have high influence, but they can be considered the biggest fish in a little pond. Non-Mormons generally have a very poor view of Mormons, so a conversion would probably darken their view of you and apply some kind of Infamy modifier, negative influence, which would not last forever but would work. Also consider for Mormon leaders, bringing other well-known and powerful people into the circle where you have near-absolute control might also lessen your own influence, as you'd have to contend with other people leading the group, more slices of the pie as it were, just something to consider, changing religion at this time for public figures would not be without consequence.

Voices raise after Kearny's speech, there seems to be a great deal of confusion. Who is a "foreigner" or represents a foreign power, and who is a Californian? A few scuffles break out when Californios jeer at Anglo military officers who still wear their American uniforms, "Who ees representing a foreign natione?!" With the lack of any clear consensus as to who is or is not a Californian, the pronouncement seems to have been ignored by the vast majority of attendees, almost none of whom have any kind of documents proclaiming them to be from anywhere, let alone California.

With the cry for votes ringing through the halls, the matter of the franchise is made clear first. Despite a relatively close count in the beginning, the widely expanded franchise ends up carrying the day, with more than 57% of the vote, an absolute landslide! It seems that freedom will truly be expanded in California, with a wider franchise than any other place on Earth, and the first true nation to allow women to vote!

The vote for the future division of the nation was seemingly closer, but quickly shifts in favor of a nation composed of a number of semi-independent states! 58% of the vote chooses to create states along the American line, perhaps an indication of the strength of the Anglo voting bloc, and only 36.2% of those at the hall voting for a strong federal nation without states.

Thus the debate begins to center on the idea of states. Which states should exist, how should they be divided up? What proposals do people have for the various states? People begin to pore over maps, and to create proposals for various states. Some speak up for ethnic states, one for Californios separate from others in the south, others suggest religion might be a meaningful basis for the creation of a state, citing the example of Maryland. To impose some order on the process, the following rules are established for creation of a state proposal:

1. States can not encompass land outside of the region known to the Mexicans as Alta California, from the Pacific on the west, bordered on the north by the 42nd parallel, on the east by the Rocky Mountains and New Mexico, and on the south by the Gila river.

2. States must have a capital, and that capital must currently exist as a settlement. No state can be built upon unsettled lands, that area will remain as unincorporated territory.

3. States should be relatively compact and follow geographic boundaries in some meaningful sense. Mountains, rivers, climate zones, these are the means by which reasonable men create a border.

4. Considering the lack of transportation and infrastructure, no state can extend more than 300 miles in any axis that could be drawn across it, in order to maintain a government well able to meet the needs of its people.

OOC: You, the players, shall make up maps based on existing settlements within the game map, with the addition of the Mormon settlement at Moroni (real life Stockton, CA). As soon as we have at least three potential maps, we will vote on them.

For those not poring over maps, citizenship in this new Republic is now the issue most pressing. With the sudden arrival of the Chinese, the Mormons, and a veritable flood with the discovery of gold, California must know who is a citizen! With the franchise having been extended to persons of any race, religion or creed, the possibilities for citizenship are relatively narrow.

A. "The Brannan Plan" - Citizenship for any permanent resident, upon some waiting time to establish residency; an oath of loyalty; and working knowledge of the English language. Citizenship may be expedited through some service or payments.

B. Expansive Citizenship - Everyone who declares, in whatever language, their intent to become a citizen of California may do so! Let the doors open!

C. Narrow Citizenship - To establish citizenship in California, one must first reside in the state for ten years, not inclusive of those who currently abide in California.

D. Citizenship by Service - To become a citizen of California, one must make some action or service to benefit the Californian state. This might entail multiple means, such as military or government service, corvee labor, or monetary payments.

E. No Citizenship - What is the meaning of citizenship except to separate one man from another? Let all the people of Earth be citizens of California, and let us not have any clear line distinguishing men from one-another! Any man who shows his face at a voting place may cast his vote.

F. No Citizenship plus Nudism - We agree that there should be no citizenship, and that humans should abide in a natural state, free from the fetters of clothing, we will learn what it means to appreciate one another and the human body once more.

OOC: So it looks like we have three choices of maps, the Bonaparte map, the Young map, and the Fremont map. Choices will be between those three, unless someone pops up with another map they'd like to include. Still a lot of people who have not voted on citizenship, but once we go through that, the final discussion of this constitutional convention will be based on rights. Thus far we've essentially copied the American system wholesale, while introducing more liberal reforms as to who gets the franchise. Well, one of the keys of the American system is the enumerated rights. I'd like to hear some suggestions for additional rights which might be proposed, or changes to the American system, which would be essentially 'amendments' to the American constitution, and should be framed as such (and equally brief). For example, a right to freedom of speech, a right to freedom of the press, a right to freedom from want, a right to a piece of land, those are the sorts of rights we will vote on, each one individually. Once that is done, the constitutional convention for California will close, and we will shift to a more freeform portion of the game. So, please start proposing and discussing additional rights you'd like to see in our Californian "Bill of Rights"

As electoral wrangling continues in the Niantic, some men are looking to their leaders to cast votes for who should be a citizen of the Republic, or what form the states should take! "Where are Kearny and Stockton, the two august men who claim to lead our Republic?"

A group of petite, confused Mandarins, their queues swaying as they avoid the bearlike Anglos, seem utterly nonplussed! "What do these foreign devils say? The ocean devil-ghost tongue sounds like the wagging of dogs, and there are none here to translate for us, to tell us where we should cast our vote! Where is Dong, Wang, or Chu to speak for us?!*"

A group of Valleyan businessmen search for John Sutter, speaking openly about how he is nowhere to be found, while a small group of Texans drag Hays out, drunk as a sot, and try to sober him up to make a statement or two they could follow. Men decked in bear-skin furs and coon-tailed caps stand aside with rifles rested uneasily along their laps. Where is Kit Carson to tell them what would be best?

OOC: If people ignore votes, they will simply lose influence, this is not to punish you, but rather to represent that NPC population is going to follow people who actively put their word out and seek to influence others, rather than following those who seemingly don't intend to even make their own views on issues of importance clear. At the same time, those who actively debate and try to convince others will receive an influence boost, representing their increase in standing among their fellow citizens.

With most of the men in the hall now settled on the debate between Brannan and Fremont, and others enraptured by the words of Bonaparte and Brigham Young, leaders are clearly emerging, and they are not necessarily those men who have held leadership and influence before.

Now men are speaking out, "Kearny served us fine as the nation was born, but I'd rather see Brannan president! We've got to figure out how to choose a new President upon the formation of this new government!" "You're right that Kearny needs to be out, but it's Fremont who we should listen to, not Brannan, who is a Mormon and a city-slicker!" The general consensus seems to be that there must be a new choice for President at the conclusion of the convention, which leads to discussions as to how the President should be chosen in general:

1. Let us continue with the American system! An electoral college, based on senators and representatives, which keeps the vote from the hands of the commoners, and finds a balance between the states and the populace as a whole!

2. The states have no right themselves to elect a president, that right belongs to the people! Let there be a direct vote for President, one man, one vote!

3. The people of this land are too diverse, the distance too far, the communication too poor. Let the Californian Senate choose the President from the great people of the nation, including their own number. The representatives of the people will make the best decision.

4. This is a vital land, let us have a vital President! The Californian President should be the manliest among us! Let a series of physical contests and competitions winnow the field, and the last man standing will be the best among us!

5. Physical contests and competitions are well and good, but let us partake in each of them with both the ancient spirit of democracy and in the manner of the Greeks and Romans! Let the physical competitions take place in the nude!

The votes are tallied, and soon the decisions have been made. It seems that the Brannan Plan for citizenship is to be adopted by California, while the President will be chosen via Direct Democracy with one man, one vote. Mr. Fremont's map is given near-universal acclaim, and it seems that California shall begin as six separate states. The Constitution of this new American Republic is taking shape, though for the most part seems mostly cobbled together from pieces of the old one, with a more democratic character by far. Yet as the American constitution is dissected here among the motley crew of the Niantic, the freedoms that have been outlined in the Bill of Rights are seen as somewhat lacking, or not entirely perfectly formed. There are other freedoms to be had, and perhaps those which existed in the past now need adjustment. A list of Rights is to be created, and each will be voted upon in its turn. A secretary is asked to present himself as willing to collect this list of rights, along with a short description as to what they would protect, and the name of the author. Once the list is fully compiled, each attendee will be given a list and asked to vote yes or no to each right, individually. Thus California shall have its own bill of rights!

In addition, with the boundaries drawn for California's new six states, questions come up as to who is actually a citizen of each state? It is determined that the Senate shall be elected from two members of each state's delegation here among the representatives at the Niantic, and the Senate shall oversee the functions of the House until proper apportioning of the territory can be done such as to create house seats, to be done within one year's time.

OOC: Thus, there are two things you guys should focus on for the next day or two. First, someone should compile a list of potential 'rights' as detailed above. Second, figure out who belongs to which state, figure out two people from your state to be Senators, and give your state a name. In the case that two people from a state disagree as to who should be the senator, whoever can pool the most influence from within the state shall be declared the winner. Also mind you, once you choose a state, you cannot move to another state, though you can later move to the territories if you wish (and thus potentially set up a new state).

As the voting for California's own "Bill of Rights" concludes, an awed hush takes over the Niantic. The votes are tallied, and everyone in the room falls silent as they seek to learn which of the various rights will be applied to the people of California.



Thus, it seems that Frémont's rights, copied nearly wholesale from the American Bill of Rights are the only ones to pass:

In a nation founded by Americans for the most part, it would seem that none are entirely comfortable with the granting of additional fundamental rights. Some take this as a clear sign that the American system is superior, and that time has been wasted hashing out the same conversations that the Founding Fathers had three generations ago. Others are frustrated, they find the lack of foresight on the part of many of the other representatives damning, and worry that the problems of the slavery system will make themselves felt here in California as well.

The convention seems to be winding down. A fully American document has been crafted for the people of California, a copy of the American system wholesale, down to the cutting out of states with no historical basis from the whole cloth of Alta California. Now, all that remains to be determined here is who shall lead each state, and who shall lead California altogether? With an American system, an American executive is the necessary linchpin to hold it all together. Two men now have their hats in the ring for the office of President. Mr. Frémont, who will come to be seen as the architect of the Californian constitution more than anyone with his domination of the bill of rights, and General Kearny, the elder statesman of California if such a thing could be said. Let the vote for President begin!

OOC: I would like everyone to consider a few things. Each state is going to develop a character fairly quickly, diverging from the others. This could be in culture, in politics, in whatever else, just as the American states differ from one another. This is NOT a vote, this is a discussion between the people who live in the states. What should your state represent? A bastion of liberalism or conservatism? A center for Catholicism, for unassimilated Germans, for anti-British fervor? Would your state be known as a center of immigration? A center of commerce? A center of industry? A place where the population values learning? An area where freedom is celebrated, or a state where intolerance rules, or a state where slavery is the king? These things are entirely for you guys to decide. The decision must be UNANIMOUS among the people who live in each state. When every 'citizen' of the various states agree on TWO characteristics for their state, present them to me somewhere. A hushed silence comes over the room. Men write their names on scraps of paper, nothing more august available for the final ballot. The candidates, Fremont, Stockton, and Kearny, each make their ideas known. Fremont openly campaigns for the position, making his schemes known to all, every thought he has, every idea, explained in detail as one man to another. Stockton and Kearny on the other hand, adopt a more staid manner, seeming to find much in the way of campaigning beneath them. Perhaps it is their military training, or a throwback to an older sort of politics as evinced in America's earliest days. The vote is fairly tight, neck and neck. Mr. Bonaparte is the last to cast his ballot, the deciding ballot. As the votes are counted, the tally is finally revealed:

OOC: This is the current composition of the government thus far. We have a senate of 12 senators, and a house of 50 representatives. There are no established cabinet positions as of now, it is up to the president to appoint those whom he may wish to serve in the cabinet. Serving in the cabinet would not work with serving as a governor or member of the senate (I'm not going to bother modeling players as house members).

We are now in the Freeform Action portion of the game. I want to keep this roleplayable as much as possible. We're going to have a one-week cycle of actions, starting on Mondays and ending on Sundays, unless everyone literally uses up all of their stuff before Sunday. Each character has 10 AP at the beginning of a cycle, action points, which are a kind of vague currency which represent how much you can do during your turn. Each character also has a number of stats. Taken together, your AP and stats will reflect what you can accomplish, and to what degree.

Stat generalizations: 0 = Completely useless, 1 = Incompetent, 2 = Average, 3 = Fairly good, 4 = Excellent, 5 = Amazing, 6 = Superior, 7+ = The highest levels of human achievement

Fixed AP Costs: A few things will have fixed AP costs. These are standard and non-negotiable. This will be edited from time to time if I need to add or change anything, so look carefully! None of these AP costs can be transferred to another player in any way.
Travel = 1 AP per 200 miles of travel
Governors can get a House Representative from their state to vote as they like for a cost of 1 AP per vote
Governors can get a Senator from their state to vote as they like for a cost of 2 AP per vote
Proposing a Piece of Legislation = 1 AP cost, available only to Senators
Voting = This is free, you do not need to pay AP to vote, only available to Senators (and the Vice President in the case of a tie)

Arbitrary AP Costs: Most of the things you want to do will cost some vague amount of AP. Whatever thing you want to do that will change the world should probably cost some AP. Things like building something, encouraging immigration, cleaning up the streets, enforcing law, mining for gold, enacting a business plan, all of these have an AP cost. Want to know how much something will cost? Ask your GM. Want to know how successful it will be? Ask your GM. Send me PMs on Discord and I'll reply ASAP, send me PMs here on somethingawful.com.

Posting Your Actions: Once you have an idea of something you'd like to do, and an AP cost for it, you can post it in the thread. When you post, do NOT post the success of your action, but rather your attempt. This gives other players the chance to try to stymie your efforts, undermine them, assist them, whatever. As the GM, it's my job to arbitrate the success or failure of any actions. Thus an action post might look something like this...

Common Man: 5 AP - I'm going to try to encourage immigration to Golden Bay state from Ireland. I have an economics stat of 3, a charisma stat of 4, and an influence of 4, so I will be using some of my own wealth to subsidize the ticket prices for any Irishman who wants to come.

GM Responds: The company agent you speak with seems confident that with the opportunities present, and your subsidizations, a veritable flood of immigrants will arrive in California, but it may be a year's time or more before they begin to arrive. (-1 Influence to your character for a while as your wealth is temporarily depleted)

Private Actions: Let's say you want to do something secret, like kill someone or sabotage their plans. You can tell this to me secretly, don't post it in the thread. All secret actions will have an increased AP cost since you're trying to keep them secret!! Voting however, and shifting votes, will not count as secret no matter what, since only governors can do it, it'd be no surprise who did it.

OOC: Just want to remind everyone if you plan to visit the feast in Moroni, it will cost you at least 1 AP to travel there, and then to travel wherever you are going after that is done, if you don't plan to stay. Senators, you should plan to be in San Francisco for voting and government business. Governors, you should be back in your states. I want travel to be meaningful here, and inconvenient, because it really was at the time, and going from place to place was a big thing that took days, weeks or months. (5 months to go overland from the east coast to Sacramento, for example. Similar time to sail via Cape Horn to San Francisco.

As the constitutional convention draws to a close, California is vibrating with energy. The feeling of a new nation is palpable on the streets of the firmly rechristened San Francisco, and it culminates in the Great Feast, a formative event steeped in metaphor which will be forever enshrined in Californian history, like the signing of the Magna Carta in England or the first Serb to wrestle a hog and win. (I will let JosefStalinator make the post as to the specifics of the feast, who is there, and then I will detail the results of it after he puts that out.)

Ever the mover, always abreast of the trends, Sam Brannan moves to expand his printing presses with the purchase of new equipment and workers. Brannan's voice is near-omnipresent in San Francisco. Every man who steps off a ship grabs a Brannan daily, the hyperbolic headlines driving them further into the Sierras to search for gold! (+1 influence to Brannan at the end of the turn cycle)

Elsewhere in San Francisco (Which the Chinese still refer to as Gum Shan, Gold Mountain), Dong Reagan is taking the first steps to bring citizenship to Chinese immigrants. A new school, Saint Augustine's Starter School, is established in the city. Offering classes in English, civics and literacy, as well as practical mining methodology. The courses for anything unrelated to mining are going completely ignored, with questions of citizenship and any desire to learn the English language paltry at best. Classes on mining technique are attended with gusto, and even bring in a steady stream of income which supports the few female teachers and invalids who are the only persons able to be retained to work there. Gold fever however, leaves little time to such practicalities, and amateur hunger often reaches the boiling point after a few days of waiting, each student abandoning his classes to head out to the mines and streams of the Sierras. While many who had high hopes for the school are currently disappointed in the few serious students who spend any time there, it is the first school in San Francisco and its focus on practicalities and adult education are well thought of, and many miners who head east leave with a better opinion of the Chinese.

In the mountains fifty miles to the northeast of Sutter's Mill, a new polity is taking form, Downieville. Along what is coming to be known as the Golden Chain Highway, hugging one of the innumerable rivulets running up the Sierras, a mining encampment near some of the richest panning areas and quartz veins is growing more famous by the day. Whispers of the riches in Downieville are found from the docks of San Francisco to the newly raised clapboard hovels of Moroni, where Mormon farmers glance at newly sown fields and then look away, to the mountains in the distance. Many miners are heading there, though first stopping off at Sutter's Mill along the way.

Mr. William Walker, a man of little consequence, embarks on an epic trek to Texas, to spread word of the discoveries firsthand, and to seek investors. He will be long away.

In a surprise movement which does much to raise his esteem among the sailors, Commodore Stockton asks his men to perform one last action, to build the docks and berths necessary to mothball the Pacific Fleet. The constant trickle of desertions has shown the Commodore that it would be a fool's errand to try to keep them there. "Sir, when this fever is over, we'll return to you, if we ain't all rich as Midas by that time, that is." The goodwill he has engendered among the men is palpable, and many weep openly as they salute their captain upon their dismissal with honor. As the former sailors make their way into the interior, word of Stockton's nobility and understanding of the problems of the common men spreads like wildfire. (+1 Influence for Stockton among all citizens)

As time passes, fewer and fewer people can be found in San Francisco. The number of men returning to the city with pockets and boxes full of gold dust has convinced nearly everyone that any labor besides panning for gold is meaningless. Who will take wages for even a kingly $5 a day when one can make $20 to a hundred dollars a day in the rivers? Laborers are hired in the city, only to disappear from existence overnight. Theft throughout the city is rampant, and all prices are gouged to the point that many among the city are having difficulty paying for food, let alone growing any. Ships are entering the harbor from the south, packed with goods for miners, and pans and shovels sell out within an hour of arrival, mobs of men sitting by the docks. The few goods that manage to make their way inland end up at Sutter's Mill, where Sam Brannan inflates the prices even further. (+1 Wealth for Brannan and +1 Wealth for Sutter). All those who are not mining are engaged in the sale of necessities to the miners. Women tour the camps and retire after a month of prostitution, having found their own gold mines within. Gold fever is at its height, and though the populace increases in torrents as boats offload their human cargo, there is no ability to control it. When one ship is stopped by a well-meaning Republican who attempts to register all of the passengers, he is beaten senseless. Lawlessness is growing in the camps, with no clear system of title to land, murders are common, and bodies are left unburied as their murderers work their former claims a few yards from their corpses. When some speak of government in the camps, the most common refrain is, "I'd believe in a government if I could see it, but everywhere I look I see man and gold, and you've got to get through one to find the other.

The Great Feast is certainly one for the record books, the sight of so many of the Founding Fathers of California gathered together will become a common one for children in California in the future. Californian artists will reproduce scenes from it akin to the Last Supper, with future betrayal and scandal hinted at on the faces of the guests, none of whom seem to note anything other than the genial atmosphere. As guests depart and make their way either to the Gold Fields or back to their homes, they carry with them an overwhelming sense that the nation has gotten off to a good start. This sense of optimism, that a nation can be birthed by such a diverse group of men without serious conflict will become seen as part of the birth of California's national character. While the Prussian is dour and rigid, the Japanese obsequious and fawning, the Italian lecherous, the Russian besotted, the Californian is the boldest optimist in the civilized world. There is nothing that a Californian cannot do, they will always seek out a way around, or an alternate means to an end. While critical historians of the future will see this attitude utilized as a way to gloss over California's tremendous social and economic inequality, the average Californian looks askance at any man, woman or child who affects a negative attitude.

With his ships mothballed successfully, Commodore Stockton sets out on his expedition to the north. Taking a single powerful ship along the coast, along with a fast cutter to act as a messenger, with a detachment of mountain men and others who think that this might allow them to be among the first to discover a new mining region rich with gold. Along the lines of Alexander's march through Persia towards India, the men plan to march along the coast with the ships sailing slowly along in support, to allow a superior surveyance of the land. With fanfare, the men set off from San Francisco and ferry north across the bay, heading out to map the north.

A great number of letters are sent out, not only spreading the news of California's new government, but also encouraging immigration to the state! Multiple nations in Europe, the Southern states of America, intellectuals, working-men, revolutionaries, all hear of the immense freedoms bestowed in California alongside news of the new "mother lode" southeast of Sutter's Mill. It will be some time before these letters reach their destinations, as the mail has completely ceased out of San Francisco.



Nearly every ship entering the San Francisco Bay Harbor is actively being abandoned as the passengers and crew both make their way to the gold fields. A few daring captains chain every member of their crew upon arriving in the harbor, but far more captains abandon their ship alongside their men.

A ship heading in from the north bears news, the British have established a port facility at a place being called "Gold Beach", in the Oregon Territory. The gold finds there begin to draw some men onto ships headed north, as the distance from the coast of the California mines suggests to many that it will be far more difficult than simply sailing north and "picking nuggets from the beach".

In the east, emigrants from the United States speak of terrors out in the territories. Crossing the black desert, hundreds dead of camp fever and cholera along the Humboldt River. Fields of oxen mummified.



In the mad rush to reach California, the 49ers are attempting shortcuts through impassable mountains. Ascending the eastern branch of the Sierras is akin to climbing a ladder, even oxen are forced to walk up on their knees. Men can stand straight up and place their hands on the land before them without bending. While from the peaks the land slopes gently to the west, crossing the Sierras is a horrific trial, especially after the deserts and wastelands of Utah, Idaho, Nevada and Wyoming. The middle class men (and a few women) who ventured west from the United States were not prepared for this. Some who descend now, starved and sick, speak of entire wagons crashing down the mountains, women and children left dashed on the rocks, unburied. There are even reports that miners are leaving false signs or trails designed specifically to lead men, women and children to die in the wilderness to avoid future competition at the mines. Horror stories of cannibalism at the peaks akin to that of the Donner Party or worse are whispered at campfires.



New trails are being forged however, across the Sierras. They are leading to new gold mining communities. A route to Downieville is found from beyond the mountains, and a southern route towards the new "Mother Lode" is struck to the new community of Mariposa in the state of Nimrod, which quickly blows up in size. Almost 100% Anglo Protestant in character, these new immigrants still consider themselves strongly American, and many have been found laughing at the prospect of a Californian Republic. A few thousand miners populate the broad region surrounding Mariposa, and many have been actively beating up and terrorizing Mormons who enter the region to take advantage of the Mother Lode, showing little respect for the state of Nimrod, and less for the Saints themselves.

In Sierra, the mining regions are similarly lawless, the Ranger patrol not having yet reached the area. In the capital of Nueva Helvetia, people take the election of a Chinese as governor of the state with about the same amount of gravitas that I take my own town's election for "Pet Mayor". People speak about the powerlessness of the government, and consider it little more than a scheme to enrich a few well-heeled individuals from San Francisco, a kind of organized corruption.

In San Francisco, Mr. Sam Brannan utilizes some of his wealth to attempt to further monopolize the power and wealth at his disposal, by purchasing large tracts of land next to San Francisco's docks. In doing so, the price of land anywhere adjoining the ocean and near to San Francisco soars, and is in part the impetus of a tremendous increase in the price of land across San Francisco. Everyone who is anyone, with even the slightest wealth, begins purchasing land to open up goods shops, hotels, saloons, flophouses, gambling houses, whorehouses, regular houses, any houses, the city is on a building spree, and with title to land still a difficult subject to enforce, a terrible conflict brews. Gangs of indigents and toughs begin to demand payment for protection, and the eastern cultural habit of dueling private fire stations setting fires and demanding cash to put them out begins to spread. Some speak of a gold rush without any gold, as everyone in San Francisco with any land or claim to land is enriched on paper. The question of actual demand for much of the dock land is not a question on anyone's tongues at the moment, as most ships are merely being abandoned in the bay.


[b]In the state of Sierra, Charles Lucien Bonaparte works to establish the first schoolhouse in the area. Though there are relatively few children, they begin to attend, though irregularly, while their parents are working in the mines. Though the school also makes mention that they will teach Chinese and Indians English, none attend, the Indians disinterested and the Chinese occupied by gold fever.


A new institution is put together which will live forever in the annals of Californian history, the California Rangers! Mr. José de los Santos Berreyesa's petition to President Kearny and the Senate to institute the Ranger system being successful, the recruitment proceeds apace. Though many of a rather undesirable element initially show up to try for the jobs, thinking that "enforcing the law" on miners will amount to little more than state-sanctioned racketeering, the deliberation and care with which Mr. Berreyesa makes his recruits soon separates the worst of the lot. A decision was made early on to constitute the Rangers as a highly diverse group. 200 men, 50 Protestant Anglos, 50 Mormons, 50 Californios, and a mix of halfbreeds and Indians, Negroes and Chinese. The men generally stick to their own communities, which causes some difficulty in the beginning, and training is sparse, with the overall qualification seeming to be lack of moral turpitude. Experienced trackers are found mostly among the Indians, while the Anglos and Mormons are mostly middle class cityfolk, with a few mountain men thrown in who have no desire to toil in the mines or rivers. While the Rangers are initially a disparate and raw bunch, their patrols through the wilderness of California, and their dealings with bandits, outlaws, claim jumpers and all other manner of depravity will quickly forge them into a toughened nucleus of a greater force, akin to the Texas Rangers or Royal Canadian Mounted Police.


Mrs. Jessie Ann Benton Fremont makes a bold play for using the resources of her position as Postmistress to create a government-sponsored mining claim to a large area of the Sierras, but with President Kearny's comeuppance and Mr. Sam Brannan's publication of this malfeasance, she slinks back to the shadows for some time. In those shadows however, she uses her time to work the mines herself, or rather, at the head of a large contingent, on land claimed by the Frémonts. The claim is successfully worked for some time, and a few sizable nuggets are produced, but nothing outsized or amazing. Overall, as Mrs. Fremont is not opposed by any real effort apart from a belittling and a few snarky headlines, and she backed down on her own, it has no effect on her influence (Spent AP if you want to harm someone from something like that in the future).


In a mining camp at the edge of the border between Sierra and Nimrod, Mr. James Sinclair utilizes a shipment of Hudson's Bay Company materials to set up a store directly in the mining region. Men from a hundred miles in either direction make their way to the store to purchase foodstuffs at inflated prices, often paying directly in gold. Centered right along the "mother lode", the most dense area of gold discovery, this mining camp explodes in size and though obviously of claptrap construction, greatly increases Mr. Sinclair's wealth (+2 wealth, you got very lucky!)


In Sutter's Mill, Mr. John Sutter makes his way back to personally supervise the mining processes near to the area. As the population of Nueva Helvetia grows, and other stores come into being, Sutter's Mill is increasingly being bypassed. With shops opening closer to the mining regions to the south (the mother lode) and also in San Francisco where emigrants first disembark, the need to purchase supplies in Sutter's Mill or Nueva Helvetia is decreasing, and the rampant price gouging of a few months earlier is becoming more difficult. With the changes in Sierra state due to the clear shift in the political winds, Sutter generously (some say forcedly) ends forced labor, mostly by Indians, on his land. With his stranglehold over most of his workers broken, many depart, never to return. The few who stay seem to be mostly women and children, among them several of Sutter's rumored squaw women and halfcaste bastards. A few Anglo laborers, maimed or injured and needing the work, replace some of the Indians, but Sutter finds himself with far fewer laborers than he had in the past, though of a much higher quality. Mining continues near the mill, but as the epicenter of the original gold discoveries, it seems that most miners are moving on much like a swarm of locusts. Sutter's wealth is increasing, but at a relatively slow rate, and in comparison to others who are finding newfound riches elsewhere, he is losing in comparison.

In the meantime, Mr. Sergei Sokolov once more makes legal news with his bald-faced some-say-salvage-some-say-piracy of abandoned vessels in the Bay Harbor. Having hired a small crew to shuttle between the vessels looking for useful salvage, Sokolov instructs many of the ships to be broken down and sold for lumber to build some of the wharves and warehouses which are coming to dominate the shoreline here. A clamor goes up from among the citizens of San Francisco who remain, many of whom have left property elsewhere in the trust of their friends and neighbors, and look at Sokolov as little more than scum. Calls rise through the city to have the government deal with this issue clearly, before it descends to mob justice.

From San Francisco, the newly appointed Rangers begin a long march to bring law and order to the people of Northern California, embarking on a circuit which will take them from Jefferson through Sierra, then down to Nimrod and back. This is a bonding time, and will be remembered as a formative experience among the Rangers for generations to come, with every new class having to engage on a similar roundabout of the nation.

Our dear leader, President Stephen W. Kearny, having heard of the disorder in Mariposa, immediately marches south to deal with the miners in Mariposa. He declares that if they doubt the government, he shall show them in person! A number of former members of the Mormon Battalion, along with a number of angered Mormon youth, head along with the President. A number of recent arrivals, heading in that direction anyway, join along and the march becomes something of a festive atmosphere. Each day, President Kearny waxes lengthily on his political and moral philosophy, and the caravan marches towards the southeast. Passing through the growing city of Moroni, more Mormons join the group, which is increasingly taking on the tenor of a revanchist mob rather than a disciplined military column, men speaking more of revenge against those who have slighted Mormonism and the state of Nimrod than Californian law. As President Kearny arrives in Mariposa at the dawn of winter, the situation is delicate. The miners have enriched themselves greatly in the meantime, and set up a local government of their own. As day breaks, a mining leader marches out to parlay with President Kearny (Kearny leads about 100 troops, some more effective than others, willing to engage in combat with the miners. I will handle the negotiations during the turn)

THE COURTS
IN the case of M. Sergei Sokolov versus M. Johann (John) Sutter, the court decides overwhelmingly for Mr. Sokolov based on the preponderance of evidence presented by the Russian emigre. Mr. Sutter is ordered to make a payment in the full amount of $10,212 plus damages. If Mr. Sutter makes this payment it will result in a loss of 1 wealth.

THE SENATE

* The Nominations of President Kearny pass.
* The Ranger Recruitment Act passes, auditors consider that the Rangers will require an upkeep of 3 wealth per year to maintain at their current level of 200 rangers. The cost of the armored and fortified headquarters will be 5 wealth to establish a stone building.
* The Chinese Inclusion Act passes. While Anglo Protestants cheer the obvious built-in favoring of their race and religion, the tricky matter of enforcement comes up. With border controls non-existent, the ability for any form of governmental authority (which apart from the Rangers does not exist) to bring the act into being is severely diminished.
* The Slavery Devolution Bill passes, passing slavery to the states.
* The Security and Revenue Act passes, in an attempt to mollify the serious delinquencies of the Chinese Inclusion Act, establishing a bureau of enforcement and a revenue system of tariffs. Although no actual law on tariffs has been posted, the system is set to collect future tariffs, and pay for itself with those. Planing the bureau in all port cities will require 3 wealth in each port city and 5 in San Francisco, though this ignores the fact that a large number of settlers are entering and departing California from the east, where controls are non-existent.
* The Postal Service Act passes, establishing a postal service. It will require 5 wealth to set up initially, and a further 3 wealth per year to continue running. The Postal Service will have multiple good effects on the nation once it is fully established.

This would be a question for the government to answer. Originally all commerce in California was required to go through Monterey, which obviously didn't happen either during Spanish or Mexican control. We are in a free-for-all at the moment, but the US constitution would not allow a single entry point for all commerce nationally... that would be a matter for the states.
