So a friend just won a hummer on ebay.

He used "Buy it Now" to grab it.

The dealership immediately realized their cock up. Their entire online inventory had the decimal place off by a few positions. They had a Phantom for $172.00, and various other cars in the $50-250.00 price range.

Obvious mistake, but my friend may be bored enough to litigate it [he already owns 6 H1's and various other cars]. He's laughing it off, but I seem to recall cases where Dealers weren't let off the hook as easily in cases like this.

There was that M3 last year but that was over $60,000 vs $67,000 where the dealer actually came around and sold it at their loss.But in that case it wasn't as extreme as this.

It's a good laugh either way.

Update

The dealership claimed the auction was invalid, and wanted to cancel it after the bid.

Ebay told the dealership tough luck, it's out of their hands.

Friend is now deciding whatever or not he has a case, half the guys on the hummer forums are telling him to go for it if he has the spare money. Worse case he's out a few hundred or a thousand for initial lawyer consultation and a letter.

A Ferrari dealership will probably have enough cash to get a good lawyer, but I'd love to see this go to court anyway.

Usually when you sue someone you can stipulate that they pay your legal fees if you win. It's kind of a gamble, but I think he's actually got a decent case if he decides to go for it.

It's an audio equalizer, if my eyes do not deceive me. Allows for adjusting the volume of ranges of certain frequencies beyond "hi, med and low." So yes, it is part of the stereo system. It appears it has a master volume toggle as well.

:psyduck: I wish this weren't true. There used to be a time when adjusting the volume of certain frequencies was done more to eliminate distortion and not ruin your speakers as opposed to cranking the base so you can't here what's being played and needing to re-cone every single one of your speakers!

In a mistake in contract, a party who realizes the error at the expense of another party loses. In this case the error is so obvious that they won't need the admission. Unless there is a weird consumer protection statute in that state that i doubt exists, the dealer wins.

In the two cited cases, an unsophisticated buyer (a reasonable buyer, perhaps) might not realize that $200k+ for a Lamborghini or $60k for a BMW M3 was too little. In this case, any person would realize that wasn't a $54.90 car. (And auctions and straight sales like buy it now are different, but i don't know enough about sales law to know if it matters here).

He should go talk to a lawyer (civil law is not my forte), but he should expect disappointment.

A lawyer on another forum pointed out that E-bay auctions are not usually legally binding for real estate and vehicles due to different state laws. He did mention that Florida had no laws that would prevent this from being a binding contract so it's a crapshoot.

The guy has a large car collection, I don't think hes going to burn time and money to try to get another h1.

Frankly the $60k M3 case was a lot murkier. You can get a *new* one from BMW for $60k now.

I am not sure what case he has. In both of those other cases if was a few percentage points off of the expected price. Not 99.99% off. A court will almost always favor the defendant in the case off accidental error with no malicious intent.

If the dealership was doing this to get press and then backed out of the deal, that would be one thing, but this is clearly a human error. Wasting peoples time and feeding lawyers is a pretty poo poo-bag thing to do. All that will happen is he, a bored millionaire, will waste the time and money of a small business. It must be inherited, I cannot imagine the kind of mentality that causes someone to do this instead of something productive or at least donating the money to a charity.

This sort of horsehit nonsense is the reason we have 50 page contracts and dubious binding arbitration. Whatever happened to simply treating business relationship with respect?

It's not a binding contract because there was no intent. The 'reasonable person' standard is applied, and no reasonable person would believe that a dealership is willing to sell a Hummer for $50.

The case-on-point is the dude who tried to buy a Harrier with Pepsi points; the court ruled that no reasonable person would believe that Pepsi would sell a $20million+ aircraft for $700,000.

Not a bad price for a '66 Fleetwood. Sadly, earlier and later models pull a bit more. '68 had a bigger motor, and '63 and older had better fins! Still, go for it. It'd make me and my '66 DeVille happy =)
