Rarely, I assume, since there's not going to be much money left to recover.

The reason I really don't get the Kickstarter thing in general is that it's accepting all the risk of being a venture capitalist while giving away:

a) the potential for a share of the profit if the venture is successful, and
b) all the normal legal protections and information rights of shareholders

The fact that the backers are actively refusing to be given financial information and proper accounting of their so-called investment is just mindboggling to me.

She was trying to please the German fans, it was in an episode of Wingman's hangar, then some idiot ruined the moment by telling them, so they pulled the video and uploaded an edited version with that part removed. I have a screenshot of some German guy telling everyone what happened on the forums somewhere, I've posted it before.

Sadly nobody outside CIG seems to have a copy of the original unedited video as I'm sure it would be well viewed.

Yeah, any good attorney can bring about a litany of causes of action related to fraud. Making them stick however, is a whole different story.

The key here is that, as a crowd-funded project, they are expected and required to deliver. That is the noose around their necks whereby even when this all goes sideways, they aren't likely to just walk away because it was "crowd-funding" and thus no accountability.

And since the FTC is the Fed agency in charge of that, not to mention that the attorney generals in various States are getting involved in crowd-funding scams, it's going to be a whole lot messier than the 38 Studios implosion. And even in that case, someone went to jail for fraud. Then there's the FBI who will somehow get involved. Especially given that several parties have now been linked to the likes of Gizmondo.

The thing is that, given the amount of money that has gone into this project, coupled with the attention that it got, there is absolutely no way on this God's Earth that they fail to deliver, and get away with it. I am 100% certain that if this project collapses, even if they delivered something, the likelihood of someone going to jail is very high.

Which is why I firmly believe that they will do everything they can to deliver "something", regardless of condition, in order to get around the delivery accountability issue and hide behind "guarantee of performance" protection. They will fail due to all the promises and statements made. Which is what I said over here.

As to the finances however, we're going to get them, one way or another. It's only a matter of time now. The law is a slippery slope of procedures, loopholes and bullshit. And if you've seen the recent filings for Foundry 42 which raises more questions than it answers, you already know how important it is, now more than ever, for backers to get the financial accounting as promised.
