Whale = a big spender in a gaming setting. Originally(?) a casino/gambling term, which has since been transferred to the world of F2P and micro-transaction based computer games. In both cases, they're often targeted by the game owner because taking money from just one of them will vastly outpace the earning you can get from skinning dozens or hundreds of regular customers.

Not only that but they actually have deadlines and project plan that they follow, and have specific lists of features that need to be implemented by year end or they're cut.

Also the backers that actually spent several hundred $ on the kickstarter for Kingdom Come got handmade forged swords from a traditional European blacksmith, not lovely Chineese plastic toys and poo poo quality Chineese hats that CIG sent out to their large backers.

The fact that they included language around refunds in their TOS makes it clearer than the statutory minimum at the time. From the response they've given, I doubt they're going to give me anything, as I think they are trying to argue that the statutory time period expired two weeks after payment, whereas obviously I (and most people here ) think that they have yet to start performing the service.

I'll probably file a small claim next week. It might take a while to percolate through the system. If they take any action to defend the claim it'll cost them far more than the $200 I've given them, and it'll cost me far less to bring it as I won't bother with a solicitor. Most small claimants don't have representation; apparently the process is designed to give small claimants a fair hearing. It might even be fun!

If they hadn't included language around refunds in that original TOS I wouldn't bother. When I put the money in, like any Kickstarter I was prepared to lose it. It just bothers me that they promised to do refunds if they had the capacity and they're not, when they clearly do.

I'm not a lawyer, I don't live in the EU, and my memory sucks. But, I remember someone saying this was a right that couldn't be signed away, and the 2 weeks only applies after they deliver on the full terms of the "contract".

Ignore that though, small claims sounds much funnier.

The best part is it appears that he has a moment of realization, and it seems to cause him to forget he's on camera. He just sits there blankly with his eyes moving around on the screen, like he's trying to grasp what has just become clear to him. All of a sudden, "Am I on camera?", and a big forced smile.

I'm stunned they didn't have the whole thing choreographed, and apparently just winged it.
