I think it's pretty clear they want to have their cake and eat it too: 1) It's just an alpha, don't criticize the bugs, other alpha's are buggy too. 2) An alpha represents a significant enough portion of the final product to deny refunds. I think they're more worried about keeping the lights on than eventual court cases. I think the refunds /must/ be hurting them, and they are running low on cash as Derek said, otherwise they wouldn't be doing this. On a side note I wonder how they are paying for the servers to run the PU. I'm assuming they're using something like AWS, and that each server requires some serious hardware. I work a lot with the platform and some base assumptions are that they're probably paying several hundred dollars for each 16 player server. Which means their server costs for this month could easily add up to hundreds of thousands of dollars.
