Honestly I have no idea; jury selection consultants are a Big Thing now and presumably there's some secret sauce for which Skadden will pay (or, rather, will pass the bill along to Crytek) beaucoup bucks to zero in on the people who will feel special empathy to creators who were ripped off by an avaricious thumb man and assess huge penalties on that bastard.

A juror will have all the law bits spelled out in detail and if there is confusion the judge can explain it again in smaller words. So the trick really is making sure they think of the facts along the same lines as the plaintiffs.

And hence where I was getting at. If it comes to that point of a jury trial obviously the jury is going to "pile it on" for damages just because how both sides choose them.

And like you said, the jury instructions will be quite simplified and simplified further.
