Statement From Citizens Rights Commissioner on the TJC: On the 5th of January, Citizens Rights Commissioner Amber Russo releases the following statement: Last month, Parliament passed the Truth and Justice Act (January 3062) an unaltered version of a bill rejected a year ago. Its rejection was with good reason this act creates a closed, unaccountable commission with the power to sentence citizens associated with the old government and law enforcement structures, however indirectly. It would be able to investigate whatever it wishes with no limits, hand out whatever punishments it deems necessary and keep operating for as long as it pleases. This isnt justice. This is authoritarian persecution. I sympathize with the urge to speed up and expand the justice process against old regime criminals. After spending 19 years in a prison with no name, I have a long list of people I would like to see facing punishments as harsh as we can stomach, and a shorter list of people deserving much worse. But we cant let ourselves be led by pain and feelings of vengeance. Many people working for the old government were not complicit in its crimes. They deserve a fair examination of their guilt. Even those that are guilty of crimes deserve to have their sentence fairly considered. Even criminals have rights, no matter how much we may deservedly resent them. This new commission puts us on a dark path. A path we have been down before. A path I have been down before. This is why I will do everything in my power to fight for the acts repeal. I urge Parliament to reconsider. If they do not, I have other ways in mind. Our constitution is sorely lacking in protections of this sort, but after consulting our offices legal adviser, I believe there may be a small avenue available to us. I intend to submit an appeal to the Constitutional Court by the end of the week.

None of us wish the guilty to go free, but neither can we allow the system to revert to the status quo - justice delayed is justice denied. I believe there is a middle ground that was already put before us - Comrade Bookchin's own act of last session. Due to the intransigence of our DAL friend in refusing to submit his proposals in a timely order, we were faced with the unfortunate situation of having both pass. We now have the opportunity to rectify that situation by embracing Comade Bookchin's proposal as the path forward. I am sure that our friends in the CLF and all those who are rightfully clamoring for justice will recognize the inherent improvement on the existing process embodied in this act as well as the fundamental flaws of Comrade Victor's proposal, a bill which we were wrong to pledge our unilateral support to in the heat of a debate. Good governance can never be held hostage to a campaign promise, especially when the promise would have the results of creating an unaccountable commission with unlimited powers, even one we would create! As Commissioner Russo has stated, such a committee can all too easily fall from the righteous path, as we have seen far too many times before. In short, I propose the following. Rational Justice Act posted:The TRJ Act of January 3062 is repealed. The TRJ Act of December 3062 shall be the sole guiding legislation on the subject The SRLF stands uncompromisingly behind the quest for justice on all levels, but we cannot allow that quest to become a wedge to further divide society. We shall continue working with any who wish to support the people's agenda on any subject, be it justice reform, economic reform, or otherwise.

Attorney General Bookchin I applaud Comrade Radek's remarks and support his proposal. I fully believe the law that I proposed and was enacted through this Parliament is the superior version. I recognize the DAL's zeal for swift and absolute justice, but closed off proceedings held by those handpicked by a Minister of Justice, with no accountability to any others in government, is honestly something I expect to hear out of our student's classes on the history of the Vallstein regime. I recognized the errors in the original law, which is why I made my own proposal. I call upon Victor Knapfstein of the DAL to renounce support of his inferior law and to support mine instead. Together we can ensure swift and true justice for the crimes committed by the past regime. We shouldn't reach for tyranny as a tool to address the crimes of tyranny.

Ministry of Justice Overview (January 3063): Most of the current structures and mechanisms of the Ministry came about as a result of the previous Ministers design. During his term, he has ruled the Ministry with a firm hand, instituting wide-ranging reforms to the core institutions and principles under his remit. When the current Minister was appointed at the end of the previous month, it took his aides quite a bit of time to extract all relevant information from the senior staff. Even now, there are certain aspects of the Ministry the purpose and function of which arent entirely clear to its new leadership. Currently, the Ministry directs the following bodies: * Regional Prosecutors Offices There are four, one in each of the three major cities and one for all rural regions. They are in charge of prosecuting all criminal cases within their regions. Around 75% of staff in these offices were hired under a new process introduced by the previous Minister, which involved recruitment through independent trusted commercial agencies specifically approved by the Minister. Strangely, most of those agencies have since gone out of business. While all prosecutors have to follow the general guidelines established by the Ministry when selecting cases and pressing charges, the three urban offices are integrated into a direct reporting mechanism which allows high-level Ministry staff to micromanage the handling of any given case, while the rural office is much more independent and is officially directed to tightly cooperate with local communities and law enforcement. Current Funding: 23 million NSC * Public Defenders Registry The body responsible for managing and paying all of the public defenders in the country. By law, all citizens charged with a crime are entitled to receive free legal counsel and representation should they choose to do so. However, in practice many public defenders often demanded monetary compensation for preparing a proper defence, as the sizable caseload and low salary meant they were unable to devote enough time to properly representing each defendant. This is why the previous Minister took a heavy hand to purging a significant majority of existing public defenders from the Registry, instituted a salary raise, put in place a strict anti-compensation policy and took great care in vetting new public defenders through a remarkably quick and opaque process. Current Funding: 16 million NSC * Legal Research and Analysis This department goes through existing rulings on cases and tries to develop accurate predictive models of how new cases might turn out, as well as how new laws are likely to be interpreted by the courts. It kept a relatively low-profile under the previous Minister, with little interaction with the rest of the Ministry. Current Funding: 3.5 million NSC * Community Justice Program A strange and byzantine program intended to provide communities with a better understanding of the justice process and encourage just outcomes in daily life which runs many centers across all settlements in Sirta providing free legal advice to local residents and running workshops and educational initiatives. It also funds non-profit organizations deemed to be advancing the societal struggle for justice. For whatever reason, the bulk of the funds go to rural based entities with thin SCN footprints and minimal official records.  Comrade Luxemburg Hello again Sirta. As nice as it is to be seeing you again so soon, I do hope I won't be back up here for another few years. Now don't get me wrong, I'm gladdened by the fact that Sirta has survived our second democratic election not only intact but strengthened, and yet I wish it hadn't been necessary. Life is better than it was a year ago, but it is nowhere near as good as it should be. The fact that almost the entirety of the former opposition turned out to be criminals of one sort or another is deeply worrying, and speaks to a much deeper ill in Sirtan society. The epidemic of organized crime and corruption festering on Sirta is perhaps the single greatest threat to our young democracy, and like any infection it must be purged. As any halfway decent doctor will tell you, however, treating the symptoms is at best a stopgap measure without addressing the root cause of an illness. To truly end the exploitation wracking Sirta, we must end those powerful and wealthy interests who perpetuate this system for their own benefit. Even now they had billions and billions in their own shadowy ways for their own personal luxury. Know this, the Red Front is coming for you, and we will not stop until you have returned every last cent you have stolen from the Sirtan people, paid for every drop of Sirtan blood on your hands. But enough of such unhappy matters. I'd like to thank both the Guardian Council and our partners in the SDU for their invaluable help in making this government possible. We've certainly got our work cut out for us, but I'm confident that as long as we Sirtans stick together we'll see it through. Every journey begins with a single step, and we have years of road ahead of us. But tomorrow can wait, today should be a day of celebration. So go, Sirta, eat, drink, and be merry. Emergency Youth Intervention Board Meeting Transcript (December 3062): Second meeting transcript of the Emergency Youth Intervention Board. The date is the 6th of December 3062. Those present are Felix Meier, Frederik Hope, Oscar Rivkin, Laurie Stanton and Diane Roe. Frederick: Just before we start, I just wanted to say it's nice to see everyone again and that I hope we all had a good election night. Felix: For certain values of good. Laurie: It's nice to see you too, Frederik. Diane: Now, for the progress report. First of all, Parliament gave us 8 million NSC to pay for our preliminary set up. Diane: Second, I and Felix have worked with the local officials in Feldspar, Nielsen's Hill and Panorama to prepare the groundwork for our presence in these areas. They agreed to provide us with several properties that we have since prepared for use as common lodgings for the future applicants. Diane: Overall, we have enough space to house about 1,420 children. Additionally, 56 families have volunteered to take in willing applicants. Frederick: It's a good start. The obvious question, however, is how many referees we've had to the program. Diane: As of right now, there are 352 minors on the waiting list. Obviously, we haven't started processing them yet, since the program isn't operational. I expect that number to rise fairly quickly, though. Additionally, we managed to find 46 people with the will and proper background to staff our program, mostly ex-CLF members and some former school councilors. Frederick: Fantastic! Whilst I doubt we'll have a quick turn around, if we can get even some basic results from the program's early days, we could probably leverage that into some additional funding thrown our way. Diane: I hope you're right. At any rate, we now have to decide on some practical matters. First, how should we split up applicants, if at all? Frederick: When you say split up applicants, do you mean how we choose where to send the teenagers? Diane: Yes. Frederick: As a top-of-the-head suggestion, it'd probably be most conducive to mix them up. Not everyone being sent into the program from Topaz should go to the same location, lest we end up just moving the problem instead of solving it. This goes doubly so in the cases of gang activity, since we want to try and break up those toxic combinations. Oscar: I agree. Of course, with only three locations, we are going to be somewhat limited in what we can do. Frederick: Hopefully in the future we'll be able to expand it but until then we just have to make do with what we can, I guess. Diane: Very well. Assuming there are no objections, we now move to our next topic: How much do we want to monitor and restrict their activities outside of school? Frederick: It's a tricky question, that's to be sure. If we treat them like criminals, chances are they won't improve, but at the same time absolutely unrestricted behavior is unlikely to help at all either. Oscar: At the very least there should be a strict curfew, I think. Letting them roam around at night will almost certainly see them reverting to their previous behavior. Frederick: I was also thinking that, in some form, restricting their communications might be... advisable. If they can still talk to those people who might be negative influences, they are still going to be at risk of being led down that path. Oscar: Agreed. However, accomplishing that might prove difficult without explicitly monitoring their personal communications. Is that a good idea? Frederick: Not ideal in the slightest. If discovered it would run the risk of undoing any and all progress made. I think a better way of doing it would be to head the deal off at the pass. Only give them access to certain amounts of communication. So they might have a phone but it might only have a select few contacts programmed in, and they would not have the means to input more. Oscar: Well, that seems obvious. However, they could easily find other ways to communicate, like asking other kids at school or public access SCN-connected devices. Laurie: I think sternly warning them not to do these things is all we can really do without risking alienating them further. Maybe institute light community punishments for violators, like detention. About the curfew, we should also provide them with some entertainment, like books and games, as well as a variety of optional indoor social activities to partake in. That way they are less likely to feel like prisoners. What do you think? Frederick: I completely agree. I was thinking that the Curfew was more "Okay, just be in the house by this time" thing, as opposed to "Locked in a room with nothing to do". And yes, the communications is a show of trust. Restrictions can be put on for repeat offenders, but as a baseline they can, hopefully, be trusted with a degree of autonomy. Oscar: I would certainly hope so. Diane: So, we're all agreed on this topic? Frederick: I certainly am. Felix: Yes. I would like to suggest something else, however. I was thinking it could be useful to also require them to do a bit of community service. What are your opinions on this? Frederick: Getting them involved with the community, attempting to instill a sense of pride in their work and expose them to new trades they might not have otherwise considered? Sounds to me like exactly the kind of thing we are supposed to be doing. Laurie: That certainly sounds nice, but, in practice, won't they just grow to resent it? Frederick: Perhaps we say they have to do a certain number of hours, say, a month, but leave it open ended as to the means by which they do it. Perhaps work with the community to find appropriate activities that they can then choose from. If they get a choice, they're more likely to find something they enjoy, perhaps. Laurie: Seems reasonable enough. I think about 15 hours a month would be appropriate. We mustn't overburden them too much. Remember, they have school and are likely to be behind on their studies, and we should leave them with enough time for themselves as well. Frederick: An hour every two days would be enough to fill that out, sounds like a reasonable amount. Not backbreaking, but not entirely insignificant either. Diane: I agree. Now, we should discuss their education. Should we set some sort of targets for them, to make sure they are making progress? If so, how should we incentivize them to reach them? Frederick: I personally, and I will admit here that I am no expert, feel like that kind of thing is something that is best left to those who have direct interaction with those in the program. We aren't dealing with a cohesive group, and what might motivate one might not motivate another. Some might respond to monetary incentives, whilst another might value their freedom of activity more. Additionally, we won't be dealing with any real baseline of progress. What might be entirely reachable and sensible for one person might be completely impossible for someone else. If we say they need to achieve a certain stage of education by a set time of being in the program, then there will be those who will have that much further to learn in a comparatively shorter amount of time to their peers. And this isn't even accounting for learning disabilities, which in some people might be a contributing factor to their behavior. Those with more expertise and direct interaction with the referees can come up and institute far, far better plans than we ever could, entirely because they are able to tailor those plans to the individual, creating a framework around them instead of having to force them into a system that might not be the best for them. Frederick: In fact, I will talk with Comrade Bookchin at the next meeting, and look into what services we have in place for diagnosing conditions such as Dyslexia, Dyspraxia and other learning disabilities and how we might improve those. Laurie: I fully agree with everything you've said, but can we really expect the already overworked teachers at the underfunded rural schools to be able to deal with all of these additions to their workload? I imagine they have plenty of trouble as is. Frederick: I am completely aware of the difficulty of the situation. Even the most well-funded and well-staffed schools have difficulties with such things, but I believe that we would be doing a disservice to the vulnerable people being put into our program if we approached it from any other way. Which is why I will talk to Bookchin about what might be done to help, especially once the budget is finished and we have a firm idea of how much money we will have to play with over the coming month. One thing I will say is that weekly meetings with a councilor would almost certainly have a positive effect, at least on the educational side of things. Being able to see how they are doing with their studies, and possibly pass on to their teachers where they are struggling would go a long way. Diane: Do we really have enough councilors to handle thousands of weekly meetings? Frederick: Not at the moment, I am aware. I just don't want these people, who have been failed by the system already, to find themselves lost in a place far from home, and falling through the cracks again. Diane: I understand, believe me I do, but as with my daily work, we have to make do with the resources we have available. Frederick: Plan for the resources you have, not the resources you want. I completely understand. Sorry, I know I went a bit overboard. Just... bit of a sore subject I guess. Back to the point however, a more achievable thing would be a... introductory interview of sorts going in. See a councilor, allow them to get a grasp of where the student is educationally, and then draw up a plan there. Laurie: I agree. Hopefully we will be able to give more attention to individual students as our resources increase. Frederick: I am sure that they will. Diane: At any rate, are there any other matters to address before we officially put the program into operation? Frederick: None that I can think of. Diane: Very well. Then, the program will officially open its doors starting tomorrow. The operating expenses should be about 1.5 million NSC a month, a figure which will rise dramatically as the number of applicants increases. Current law will cover our expenses up to 3.5 million NSC a month, so hopefully we can keep costs down while still doing the best we can for the children under our care. Any further comments? Frederick: That sounds like a plan. As I said I'll try to get the budget increased to match demand, but as a starting point it's not a bad one. Diane: Agreed. Let us adjourn then.
