The Yankees shaving policy could legitimately be contested on racial grounds of the players cared that much. In other industries black workers have successfully contested workplace no beard policies on the grounds that black men are much more susceptible to chronic folliculitis from shaving.

Who knows why nobody has pushed the issue with the yanks but courts have definitely shot down these policies at other types of business as discriminatory.
