Most of those ads were from before the anti paraphernalia laws. You could sell bongs, pipes, dugouts, power hitters, coke straws, etc. at your local friendly head shop (Oat Willie's for Austin). Then along came Nancy and anything to do even tangentially with using drugs became illegal in a lot of places. The problem then became defining paraphernalia. There are so many different kinds, and so many that could also be used for non-illegal drugs (It's to stretch your tobacco use!) that it's now basically if you have drugs or residues on it it becomes paraphernalia. So baggies are fine if you have a sandwich in them, but fill it with weed and it magically becomes illegal paraphernalia. Source: got popped for possession of a small amount, got charged for paraphernalia possession, not for the weed inside it.
