Hold up. So having a gun manufactured in another state makes it an interstate crime? So what about guns manufactured overseas?

America is so loving wild holy poo poo It’s just that a pretext is necessary for the federal government to become involved. It’s a relic of a time when the federal government was less powerful. This can be as little as “defendant was growing cannabis in own home for own use however cannabis is known to be traded across state lines, therefore defendant is engaged in interstate commerce.”

Inceltown posted:Hold up. So having a gun manufactured in another state makes it an interstate crime? So what about guns manufactured overseas? The Federal government can't just pass whatever laws it wants to: Congress is only empowered by the Constitution to pass certain sorts of regulation. But one of the things Congress is specifically empowered to do is to regulate interstate commerce, which is one hell of an opening. So a whole enormous body of Federal law requires some nexus to interstate commerce to be applicable. For instance, Congress can't simply say "it's illegal for convicted felons to possess guns"; that is not a power of Congress enumerated in Article 1. However, Congress *can* regulate interstate commerce and say "It's illegal for a convicted felon to possess a gun in a manner that affects interstate commerce." Which effectively means "all guns." In practical effect, the commerce power is so wide-ranging that almost anything has a nexus to interstate commerce. In Wickard v. Filburn, a farmer in Ohio was growing grain to feed the animals on his own farm, violating wheat production limits established by the Federal government to stabilize wheat prices. He argued "I'm not selling this wheat, it's just to feed my own animals," but the Supreme Court said "No, you're not selling this wheat, but the fact that you're growing your own wheat to feed to your animals means that's wheat you don't have to purchase to feed to your animals, so your growing your own wheat is still affecting interstate commerce and Congress can prohibit you from doing it." Similarly, in Gonzales v. Raich, the Supreme Court said, by a very similar rationale, "Yes, California has legalized medical marijuana, and you're growing marijuana for your own medical use. However, if you're growing it for your own medical use you're not buying it, which means you're still affecting interstate commerce. Even though that interstate commerce isn't legal, it's still interstate commerce, and Congress gets to regulate it."

I'm going to bet the felony was purchasing the firearm in one state and not having it transferred via Federal Firearms License (FFL) dealer to the state they reside in. That's what likely triggered the federal felony charge.

That's what likely triggered the federal felony charge. Possessing a firearm at all as a felon is a Federal felony. If I'm a felon, and I buy a firearm in the state I'm in, I'm now committing a brand new crime: possession of the firearm. *I* don't have to transport or cause to be transported the firearm across state lines at all. It's 18 USC 922(g) https://www.law.cornell.edu/uscode/text/18/922 quote:(g) It shall be unlawful for any person—
