IIRC the crime was falsifying business records (to obfuscate the source of the money), and what made it into a felony was that it was being done in furtherance of another crime (election interference/undeclared campaign contribution). But this latest hush money thing is for a completely different case so I don't think that would factor in to any judgment on the felony case, especially at this point after the trial already found him guilty.
