She didn't call the police and I don't think she's made clear she actually knows what happened to either man on the boat, but she knows that the lake was calm and that no one was on the shore. I'm not sure what to object to in the testimony, but it's clear she barely noticed the guys, if at all.

Part 91: Episode 4, Day 2, Trial: Guilt Trap



This one's a little tricky, because it's indirect and it seems like a few pieces of evidence could apply. Ultimately, though, the contradiction is this: Why would she be looking only at the boat, if she were out there looking for Gourdy and had just heard the noise that indicates Gourdy has appeared?

Additionally, she had said in her first testimony that the only thing on the lake was the boat, and on pressing she was sure about that fact because she was scanning the whole lake, not watching the boat the whole time:



And the reason she was scanning the whole lake, was to look for Gourdy. So the right evidence to present here is the Gourdy Article, on which she already admitted she was out there looking for Gourdy.



We can actually present our evidence on any of the last three lines of the cross, but the middle of those makes the most sense here.

Welcome to our first guilt trap. As Phoenix hinted in the previous line, getting this choice wrong is an instant guilty verdict and game over. Fortunately, this choice is easy - it's pretty obvious that doing nothing isn't going to work here, given where we are with this case.

This situation is why, in the US, prosecutors are legally required to disclose to the defense any evidence they have or discover that could be considered exculpatory (meaning: tending or serving to clear the defendant from alleged fault or guilt). Not that it stops a lot of them from trying to avoid it anyway; a local DA here just got sanctioned for repeatedly violating this rule, including a case where for over four months they withheld evidence that proved a defendant's innocence, providing it just six days before the trial. There's even a name for this rule - the Brady Rule, named after a Brady v. Maryland criminal case in 1963 where two separate defendants were accused of the same murder, and even though one of them had confessed, the other (Brady) was still convicted because the confession was not disclosed. The case went all the way up to the US Supreme Court where it was ruled a constitutional violation (Fifth/Fourteenth Amendments), establishing the rule thereafter.

I was really curious how you would put this mecha ic up to a vote, but the grid system works pretty well.

You figure out pretty quicly in these games that "wait and see" is almost always an instant fail, though this update is interesting in that it's one of the few times "Present evidence" isn't the right call.

The pistol was fired three times. Lotta Hart heard two gunshots. The victim was struck by only one bullet. I have no idea how to tie that all together yet. Is Edgeworth one of these two individuals? Is the victim? Do we have another twist like episode, where the man holding the gun is really the victim?

I think any generous interpetation of Lotta here is unwarranted, she lied and claimed she saw something for attention and knew it. So perjury you would think would be a pretty massive terrible thing, but how could you prove that a witness thought they saw something vs what they actually saw? The mind can also just plain fabricate evidence for itself at times though so even if it is a blatant falsehood compared to the facts, can you actually charge someone with perjury for saying they saw something that simply could not have been observed? In this specific case the witness outright WITHDREW her version of what she thought she saw and claimed to not see poo poo, I feel that would be the same as admitting she lied, as compared to just sticking with her story knowing it is not like someone can prove beyond a reasonable doubt she knowingly lied.

The operative words here being "reasonable doubt". This is Japanifornina, courts here don't operate on "reasonable doubt". They operate on "guilty until proven innocent". Might be better to just say "oopsie, I made a fucky-wucky" and hope the prosecutor's too busy to take you to court.

I wonder...



I've been suspicious of the timing of this whole thing from the beginning. I think the killer shot Hammond some time earlier on the 24th, maybe even somewhere not on the lake so Lotta didn't get a picture (maybe even before she was set up), and then the body was dumped out in the lake between then and when Edgeworth showed up. And Lotta's pictures are of the killer firing the murder weapon (with blank bullets) at Edgeworth, then falling back into the lake himself. Or maybe Edgeworth fell back into the water; I don't think that fits what we saw in the prologue, though. It would be nice if he would tell us what actually happened out there, and why he was out on that boat in the first place.



Gumshoe was surprisingly helpful talking over our evidence with us, let's see what else he has to say.

You'd think defending the Steel Samurai himself would have landed Wright some money to make rent. I'm not sure if they imply that he takes on other cases to keep the lights on between the major ones or not though.

A little of both; I try to capture my live impressions when they're important/relevant. The full writeup is afterward though.

There was a comment earlier about Phoenix only having three trials before. Maybe he had some other cases that settled out of court? I thought there was another line about him not really ever having any though. Maybe he makes some cash on the side as a food delivery driver on his bicycle.
