It is unlikely that you are thinking about Con Law AND I HAVE ONLY GRADED A SMALL PERCENTAGE OF YOUR EXAMS SO FAR- but I want to share with you an initial observation concerning the first question, in the hopes that it will help you with Con Law– and in writing your other exams.



It concerns question 1.



The question pertained to a law that provides for civil commitments, initiated after the completions of one’s sentence. I asked you to address 3 potential constitutional problems relating to:



1) the commerce clause

2) the necessary and proper clause and

3) the 10th Amendment.



So far, most of the exams I have read analyze the law that provided for the original conviction- not the law that provides for civil commitment. WRONG LAW!!



The original conviction clearly refers to a law which punishes receiving child porn via interstate commerce. I don’t think there is much questions that this satisfies the commerce clause (unless you want to argue it is over broad in that it coves porn not generated as a business). That is not the statute I asked you to analyze.! The facts of the exam explain that the statute in question provides for institutionalization of persons who are determined to be sexually dangerous and suffering from mental illness at the time of release.



I specifically said: “As you can see, the required finding, that one suffers from mental illness and would have serious difficulty in refraining from sexually violent conduct or child molestation if released, makes no mention of where such conduct might occur, or whether interstate or international activities are involved.”



Thus under this law, there is no activity, much less economic activity, and there is no requirement to suggest that the activity would be other than local.



Thus, I expected you to focus on whether such legislation was authorized under the commerce clause– and so far most of you have not discussed the key facts that make this a substantial issue.

The commerce clause connection is dubious.



That brings us to the next issue: necessary and proper clause.



This is where you should be arguing that the commitment provision is but an add-on, that builds some additional consequences that begins with a valid commerce clause conviction- and from there you would discuss the scope of “necessary and proper” as to whether it broadens Congress’ legislative powers, or add nothing to the Constitution.

I haven’t seen this connection in your exams yet either.



The good new is, I am grading under the law school curve. But I want to remind you that this is a typical exam questions in that I am asking you to explain the law in the context of specific facts. To do a good job you have to spend time reviewing the question carefully to make sure you are answering what is asked.



My advice: slow down and think before you start writing to make sure you are being responsive to the question.

I went to a party last night where two sophmores got really excited when I mentioned I was a law student. They indicated that they wanted to go to law school and started crowding really close to me. Before long they were fawning over me, touching me - laughing at jokes that weren't funny. I had both of them in the palm of my hand.

I tried to give them the spiel about how you shouldn't go to law school but all that I could see in their eyes was lust, for the prestige, for the 'big money,' for me. I could have taken them right there at the party and neither one of them would have objected.

Yeah, you could say that law school was a good investment :smug:

The question regards to calculation of GPA. I know the LSDAS GPA does not throw out grades for repeated classes. My GPA as calculated by my school is a 3.66. It is a 2.55 if I throw in every grade for every class I ever repeated. This is the difference between living out the dream of alcoholism or you know doing something worthwhile. My GPA since summer 2008, once I got my academic life in order, is a 3.96 over 80 hours of mostly high level math. If I end up going the horrible route of law school is there any hope of written an addendum helping them overlook my ridiculous 2.55 or is this hopeless?

Go to a T3 or T4 with a scholarship. If you work hard you'll be able to transfer to a T14/T1. I know plenty of people who have done it, it's really no big deal.

If she would have just kept working rather than going to law school, we'd probably be around $300,000 above where we are right now. That's not an exaggeration.

Even before seeing this thread, I knew law school was a very bad idea for most people. My wife now actively talks people out of going to law school, and resents her mother for talking her into going to law school, just so she could brag that her daughter is a lawyer.

On the plus side, now your wife can think like a lawyer - who can put a price on a valuable skill like that?

Day 1 of internship: Apparently our entire class got summer work because our agency didn't want to pay for real lawyers. I am unsure whether to hate myself for undercutting graduating 3Ls (by working for free) or just be grateful that I'm replacing a real lawyer and get to handle a real lawyer's work.

Now how the gently caress do I write this motion for summary judgment? I don't even know my state's rules of civil procedure.

That said, I got hired because my writing sample was good and a summary judgment motion, and the motion I'm putting together is largely copy-pasting from previous briefs put together by my supervisor. Additionally, the case is pretty much open and shut.

Honestly, my only real issue is that I've never learned the Wisconsin Rules of Civil Procedure and I have no idea what local rules this court is using.

WDOJ depressing anecdote of the day: we have a 2L from Michigan working the same job as me. We are not getting paid. No one will get hired based upon their performance at this job. The worst part is that he seems to be a fairly nice guy.

I got an undergrad in this stuff. The only people with jobs in philosophy of law/sociology of law/the sort of thing you care about are people with Phds.

It's a fun subject of study, it's just that a JD is really peripheral. Only a couple of my professors had one and ALL of my professors had a doctorate.
