If you wanted to, you could totally trademark James Gang as a wrestling brand/stable. There are live trademarks out there for "James Gang" as the name of a printer in California and a line of barbecue/salsa condiments. I don't see one regarding wrestling, but at the same time trademarks really only forbid you from using those terms on advertisements specifically for wrestling products. No idea if Twitter counts, or if there's even been precedence set for that.

Also isn't that like a bigger body of evidence of bigotry than pretty much anything ever confirmed about Dusty Rhodes? I feel like the only actual stories I've ever seen sourced about what a bad guy Dusty were: a) He insisted in the 1970s he could be a promoter's "black world champion" (which is completely self-serving and self-promotional and quite possibly delusional, but at its base involves Dusty wanting to be the world champion and thinking he can connect with black audiences, which isn't really racist in the way people seem to assume he was) b) The story Colt Cabana told about "a trainer" calling him Kike Cabana which I don't think he ever identified who it was, but I remember a lot of people asserting it was Rhodes. Did that ever get confirmed one way or the other?

Yeah, if anything it was probably Jericho acting out on misplaced aggression. For context this was June 2002, and he'd spent the last year: 1) Getting a main event push for the first time in the Benoit/Jericho vs. Austin/HHH feud 2) Having that get derailed by HHH's injury but landing in a feud with the Rock for the WCW title 3) Spinning out of that to be the First Undisputed World Champion/beating Rock & Austin in the same night And then... 4) Being the proxy for HHH's feud against Stephanie and her pet dog, a feud where it was clear that HHH wasn't getting over as a face. 5) Killing himself in a Hell in a Cell match to try to get HHH over as a face champion 6) Getting bumped to a prelim match so Hulk Hogan and Bikertaker could be in the main events, possibly knowing the plan for Summerslam was HHH turning heel after he spent months jobbing to him, Lesnar getting a rocket strapped to him, and Jericho doing ??? Jericho has talked a lot about how tenuous he felt his job at WWE was for years, and how the Kliq didn't really like him, etc. You'd think he'd be over that by 2002 but there's no question he was hurt by how he was handled around WM18 and the idea that he was getting pushed back down the card probably hurt, and then if he read some negative reviews on the Internet (who were the people stanning for him through all of the hassles he went through in WCW/WWF) it probably extra-sucked after what was presumably a bad week at work. let's say, hypothetically that rovert is a doctor -- I know he isn't a doctor, or at least I don't think he is, I'd have to check, but let's say he is -- who is really bad at his job and keeps trying to take the pulse of y'know, patients who are coming in and his finger isn't anywhere near their wrist, or neck, or the back of the knee or wherever he'd be taking pulses. The point is that his finger isn't even frickin close to any of those places. Now, if you're a doctor the mentality is that you're trying to help people, but rovert can't even take anyone's pulse, which is really bad if you're a doctor. So he thinks everyone is dead. But they're also talking and explaining their symptoms to him, so how does it look when you're a doctor, and your patients all seem dead to you, but they keep talking. You'd probably die.
