Because it was ultimately an extremely minor offense, one that might have been thrown out altogether depending on the interpretation of the judge. (The judge ruled that since wrestling matches are pre-determined that things that overturn the ruling post-match are also subject to creative control, a different judge may have interpreted it differently). You can make the argument of 'he was protecting the legal validity of the clause'. But why even evoke creative control over a promo in the first place?

That couldn't be a Russo idea, it's too 80's, too pedestrian and features a couple of old guys who should be retired (and Mike Rotunda). Somebody snuck that one past him. Also, somebody please inform Jeff Jarrett that he has no goddamn business in any form of the nWo, including Stevie Ray's black and white. This isn't TEW, your pop doesn't go up just because you're surrounded by popular wrestlers.

I feel like I need to emphasize and repeatedly remind everyone that Russo clearly meant that to be the show where everyone would say "It's all coming together!" and recognize what a genius he is and how brilliant his storytelling is.
