Rubies posted:I felt a bunch of feelings about Obama and was actually moved to tears when he was elected, imagining me and my fellow Americans from all walks of life tending public gardens and poo poo. Now I just see him as a (somewhat more likable than usual) corporate pawn. Can someone explain to a not-very-political person why this won't happen again with my main man Bernie? Honestly my mind is already running wild with visions of all the factories moving back and everyone volunteering at after school programs and I don't want to feel stupid again :/ if he somehow got elected bernie sanders would never be able to enact his agenda legislatively because the house will certainly not go to the democrats in 2016 (due to incumbency advantage and gerrymandering) and the senate would more likely than not remain republican as well. at best he could enact changes within existing statutory framework through executive orders and regulations, and appoint liberal justices to the supreme court (just as hillary would). he would have more leverage to control foreign policy but he is not exactly a peacenik. basically: if by act of god sanders became president, institutional inertia means that nothing would change except for the same gradual reforms that would occur under hillary. but he'd be more palatable. sanders/ron paul 2016

Concerned Citizen posted:she will nominate liberals because the calculus is fairly simple. liberal justices will not overturn her policies, conservatives will. and centrists tend to drift over time so there's essentially no benefit to doing anything other than nominating the most liberal person you can get away with. exactly. justice stevens was nominated by gerald ford, and justice souter by bush 1, and they turned into the most reliably liberal votes on the supreme court by the end of their tenures. as politics have become more polarized since the early nineties, presidents have learned their lesson

Concerned Citizen posted:doesn't matter. there's no constitutional basis to overturn almost any deregulation, so appointing a conservative/moderate gains her nothing even if they agree with her. but she still supports numerous government programs that are threatened by conservative justices, so she will always want the most liberal justice possible to protect those. to clarify, this is not entirely accurate. while there is generally no constitutional grounds to overturn deregulation, beyond extremely technical issues such as federalism concerns, there are often grounds to overturn it under administrative law (which is the constitutional law equivalent of the regulatory state) when justices feel like it.

Concerned Citizen posted:i was thinking more along the lines of GLBA than executive action, but yes that's true. oh yeah she could always veto poo poo like that if ~the base~ got upset enough (which is much more likely to occur in the present era of social media than it was in 1999). i suppose sanders needing less prodding to veto it would be the primary difference between the two.
