A retailer or content site has to respond to a DMCA, but in theory the content creator can sue for $150k per instance + damages if it is shown to be fraudulent. I'm not holding my breath but it'd be nice if this was the case that broke the camel's back. Some people have had to pay out the nose or do humiliating things in order to avoid those huge fines.
