if you want to PM them "I know where you live" and post their frantic backtracking, we'll all laugh

if you want to just flat add them to their lawsuit and serve them, we'll probably still all laugh

Lmao, show a game journalist who knows absolutely nothing about the technological side of game design a scene with a static model standing in a hangar running on a custom rig and he starts foaming at the mouth that it's the best game he's ever seen, omg guys seriously. Did he ever even run one of many graphics benchmark programs before? Which by the way normally have more actual gameplay than SC has ever shown.

if the honeymoon period between game journalists and games is "the e3 prerendered 'demo' that's all in engine guys we swear" through "hey we released a game, 1080x720 30fps max and it looks like trash", obviously SC will be a literal neverending honeymoon period

Compared to other poo poo I blew money on before? Not really.

Before Plex I was spending $180/yr shipspinning in eve.

Hell a couple months ago I bought a digitech drop pedal because I was too lazy to drop down to C/D tuning.

Not too long ago I spent about $250 on a vmware course to be certified, right before accepting a new contract position focused solely on networking.

A Kickstarter is definitely not a joke, and I have no intention of making light of it. And it can be a tough and emotional thing for gamers to go through, speaking from personal experience. And I know that it's often much harder on the gamer than on the developer. However, I also know that it doesn't necessarily turn you into a sad, depressed sack of tears for the rest of your life. People can move past it, and heal.

Octopode posted:

In the US, at least, TOSes have been routinely upheld in court cases so long as they are properly presented and agreed to by users, particularly when they must be agreed to prior to entering into a service agreement. Those only available to the consumer after purchase are much less successful.

But the legal arguments weren't really my point so much as the rhetorical. If your going in position is arguing about something in the TOS should compel action on CIG's part, you've already conceded that the agreement is at least valid and applicable for the sake of your argument, and that would include the provisions allowing modification with assent.

As for why they include it--many US states defer to vendor-provided refund policies if provided at the time of purchase, but are more consumer friendly if no such policy is available.

Realistically arguing about terms of service being enforced or not is a complete crapshoot and barely worth the time. There are cases that rule terms invalid depending on how they're presented, terms of service that have completely unenforceable clauses in them, and one court case from Texas said a Blockbuster ToS was "ďillusoryĒ and unenforceable because Blockbuster had reserved the right to change the terms of service at any time".

You could, of course, with time and effort, probably find court cases from similar situations ruling exactly opposite, but a lot depends on the lawyers and judges involved, especially when it comes to "not signed by hand" terms of an online service and how well the judge in question can grok the idea of digital verification.
