I think the big lesson to take away from Gawker having to shut down is that you should not act like an rear end in a top hat or whine about how a billionaire has it out for you, even if he does, because that will make dumb Florida Juries think that you should simultaneously get millions for the potential earnings of selling your sex tape and millions for the harsh trauma and personal damage that having your sex tape out in public caused. I still get blown away by the sheer scale of what the Jury awarded Hogan in that trial, it doesn't seem like it should be remotely possible, but here we are. I guess gossipy "news" sites know that hosting or linking to a sex tape on your site is the line not to cross? You have to love that the TMZ ship continues sailing on with full wind its sails while Gawker gets washed away in a HH hurricane.

With that kind of stuff and mocking judges they really wrote the playbook on how to lose a trial. Even stuff like Hogan getting help from the FBI and Hogan wanting to control the tape because he happened to say some racist stuff on it didn't help them.

As has been said, the Gawker trial will be used in law schools for years to come as a perfect example of how to destroy a case you may have had a shot at winning, especially on trial by JURY. The people on a jury are human beings, and if you present yourself as an unlikable poo poo stain then they will have no sympathy for you. It's one thing to be flippant to a Judge, because they will gently caress you too, but it's another thing to be flippant in front of a room of people who will judge the everloving poo poo out of you.

I still contend that Gawker had an uphill battle that their deliberate bad action made worse but was not the sole cause of their loss. I can't find it handy, but just the portion of Denton reading a section of the original article on the stand was pretty damning in and of itself.
