Make no mistake, this landlord is a piece of poo poo for immediately jumping to "you haven't missed rent yet but get out or I'll evict you", and he's in California so he'll probably lose more money and time by trying to evict this guy than by just giving him a break for a few months. If you want to evict a tenant for non-payment of rent, first they have to actually not be paying rent, and second, you have to take them to court. Where do you think he's going to be living, completely rent-free, during the entire process? Plus you have to pay court costs and attorney's fees. And then if you successfully evict the guy, the apartment is vacant and you have to clean it and turn it over to try to get it re-rented, and hope he didn't trash the place because you're an rear end in a top hat, because then you'll have to spend more time and money fixing that, and maybe you have a security deposit you can use, but every day of this is lost rent.

Being lovely to a tenant in a difficult situation is going to cost this guy thousands more than it would to just cut him a break, and he deserves it.
