I think its probably ok for it to be illegal. Fortunately legality and morality are so far removed that we can keep punching stupid racist neo nazis and other conservatives in the face and laughing at them.

And to a much larger extent the legitimacy of the legal and justice system in the US where, people with monetary power or privilege can get away with almost anything, while black people are legally(this is key here, because laws and legality has no place in saying what is right or wrong) killed by police officers on an almost daily basis. I think a fallacy in US society that a lot of people(especially white liberals and conservatives) have bought into is this notion that all acts of violence are equally wrong. This idea is something you often see on TV and in movies. Punching a person because they're gay and punching a person because they're a nazi are not the same thing. The reasons why you're doing something are just as important as the thing you're doing.
