They would literally have to hold the nfc terminal directly against your pocket or wherever you keep your card in order for it to have any chance of scanning correctly. Larger amounts require authorisation and they'd need to keep it connected to their merchant account. I think it would be the dumbest possible crime but I'd love to give it a shot for a "prank" sketch because I bet it would be hilarious trying to scan peoples wallets like that.
