So, if Trump is re-elected it's feasible he'd get three more justices on the court. In addition to the RBG seat. Thomas would likely retire. Alito is already over 70 and might strategic retire. Breyer is over 80.

Because there's a meaningful difference in a court that rules 6-3 forever versus one that rules 7-2 forever in your example.

The damage to the SCOTUS is done and cannot be undone without packing the court. I don't see Biden packing the court.

I think that if a replacement is seated before the election there is tremendous pressure to pack the court and it is meaningfully likely. If one is seated in the lame duck that pressure becomes irresistible.

Yes, I know the meaningful difference is already done and in a second Trump term the court won't matter anymore. But like, just lol that if you have any concern for the rule of law at all, not seeing Biden as clearly preferable here is absurd.

Even if Biden didn't expand the court, you still don't prefer him selecting judges? I do think he's likely to expand the court if he has a Senate majority. If the Senate goes to the lengths of ending the filibuster and passes a court expansion, you think he's not going to sign that bill? They should also admit DC and PR as states and expand the House by 100 seats.

In either case, the brazenness of McConnell's hypocrisy on this, assuming they seat a justice, requires a Democratic Senate majority to right the wrong by expanding the court. It would be politically more harmful to not do it. It is the one bargaining chip they have to get Republicans to back down on it.

There are two options at this stage of the game. One is objectively better by every conceivable metric. And nobody expected Scalia to die. Just because Kav is 55 doesn’t mean he can’t have a stroke. Anyone going “Biden is X/not socialist enough/doesn’t talk about my pet issue therefore I will not vote” deserves to be scolded mercilessly.
