Scarecrow sets off weapon in Gotham Park. Then he goes to the outskirts of the city and sprays fear toxin to force more civilians to the park. Joker blows up the LOD headquarters so at this point I assume he joins up with the Joker because why not, better join the winning side. I doubt they were working together since the beginning seeing as how badly Scarecrow misread his interaction with Joker.
