The arbitration had nothing to with GEICO. This is the timeline to date as I can make out from court documents.

Prior to filing suit against Brauner, M.O. sent a demand letter to GEICO, and they determined there was no coverage and did not pay out. Likewise, because there was no coverage, they did not provide Brauner with a defense. In a standard auto case, the insurance company steps in and plays defendant. GEICO did no such thing here because there is no coverage for him giving her HPV.

M.O. and Brauner agree to binding arbitration per state statute. M.O. gets $5.2m at arbitration against Brauner. She goes to court to certify the judgment. At this point, GEICO becomes aware of the judgment and that she is trying to claim it against GEICO. GEICO moves in the trial court to intervene. Trial court grants M.O.'s request and certifies judgment and then allows GEICO to intervene in the case. GEICO appeals saying that it should be allowed to present defenses and was deprived of an opportunity to defend itself (not Brauner) against any liability. Appellate court said that GEICO had no rights to be in the arbitration before the judge let them in.

At no point has any court or tribunal decided that the GEICO coverage is operational here. GEICO filed federal suit originally in Kansas which was removed to Missouri and is in discovery. The case is GEICO vs Brauner in the WD of MO.

The umbrella policy has explicit exclusion for communicable diseases. There will be no coverage there. The standard auto policy does not have that exact exclusion and is generally silent about disease except to say that disease following injury is covered. The auto policy and umbrella policy both expressly exclude coverage for intentional actions. Although the arbitrator found that Brauner was negligent, I still think his actions very much meet the threshold for intentional.

The local news article about this case is really bad.
