From what I can tell in New York it is still illegal to give extra shots to ineligible people rather than throw them away -- obviously in that absurd situation you want to wink wink claim eligibility. By contrast in my county there are massive standby lines at every distribution point hoping to achieve an extra vaccine, teachers and essential workers are in the current eligibility tier, all appointments are getting booked within an hour of being posted, and most locations aren't even scheduling appointments except for second doses due to lack of supply.
