The CHAZ is clusterfucked and it's time to go. It was likely the Seattle plan to wait for something like this to happen - shootings that are drat near impossible to investigate / figure out, giving them an excuse to roll in and clear everything out. It's kind of a good excuse!

So to summarize - the Republican party NOW thinks that masks are important since the pandemic is in the red states. Except red-staters have been primed that masks are a liberal hoax to attack and dethrone God and Trump still won't wear one on camera. Plus, the red states won't lock down because they're led by shithead governors that would rather blame the youngs and sacrifice themselves for the Dow.

Yeah that decision really did look like a complete clusterfuck, but the agreement on severability sort of bodes well for the future of the ACA/Obamacare, as Texas/Trump is arguing that the individual mandate can't be severed, and therefore the whole ACA needs to die. If, *if* the court keeps to that reasoning, the ACA will stand.

Mr. Nice! posted:

The mandate is already gone, though. The issue is whether or not the ACA can stand without the mandate. As the mandate was the cornerstone tax used to fund the program, it's hard to argue that the law can be upheld without the funding. I think the ACA is unfortunately dead.

The counterargument is that the mandate isn't actually dead, it's just $0. Congress could've completely repealed the individual mandate, but they didn't, they just repealed the individual mandate penalty. Congress could've fully repealed the ACA, but they didn't, and none of the debate at the time was about ACA repeal either.

Technically, this whole thing would be fixed if Congress set a penalty of $1. There's a serious argument to be made that a hypothetical Biden presidency with a Democratic Congress needs to start putting court-generated rights into ironclad law - the ACA mandate, LGBT workplace/marriage rights, abortion, etc. Take that poo poo out of the courts' hands in the first place and do some actual lawmaking.

I wouldn't worry about it too much. It would take effect in July 2020, can be easily reversed, and if Donnie wins reelection, we'll likely have much worse problems.

It's also unclear if he can even unilaterally do it, as Congress might have a veto in the whole withdrawal process.

Y'all are correct, but ain't poo poo getting done to sever health insurance from employers until both happen:
1) Congress flips to fully Democratic (plus presidency, duh)
2) Medicare for All becomes a popular position.

As soon as people get presented with Medicare for All mechanics, their brains break and they yell about it being too expensive communism. They're completely wrong, but that's why Biden is heavily pushing the public option - getting insurance directly from the government as an option, rather than mandated. It's a step towards the severance of health insurance from employers and a step that Democrats didn't even want back in 2009-2010.

Medicare for All is the correct and right decision. It's also arguably electoral poison right now. Politics is stupid.
