Perhaps anyone who purchased after are hosed but if you put money in the original Kickstarter you are due a product regardless of "gifts." FTC and local municipalities have both ruled against people who did not deliver backers their due product and there are plenty of laws of what constitutes a gift or donation in terms of supporting a corporation.

When you make a donation, any gift you receive as a thank you for the donation counts against the value of the donation. While people can bicker about the value of jpegs, the fact remains CIG placed a very clear value on each ship that can be melted, refunded, gifted, etc.
