I think you mean 'could'; yeah, direct malfeasance is the easiest way, and you can't prosecute based upon a 'best effort' criminally, but that doesn't mean that civil action is off the table, particularly when you consider that _damages_ approaches tens of thousands rather than say $40. That's my fun. Missed expectations on $40 is fine. Missed expectations in the thousands requires a lot more self-delusion.
