I truly have to wonder what they were trying to do. The only thing I can think of is that they weren't expecting the spray to diffuse as much as it did, and wanted it to shoot a stream of flame into his mouth, where it would have burned the inside of his mouth and throat instead of his entire face and hair. It's such a confounding stunt since there was never a possibility for a decent payoff.

I wonder if a lot of these people have seen actual professional entertainers doing stunts with fire and then think 'pffft, I could do that!' when they don't have the equipment, training, experience, or brains. But I'm also pretty sure no 'firebreathing' trick involves the fire going THAT way. Besides, even professional firebreathers get injured or die in accidents. Drunk idiots have no good outcome.

Spoliation of evidence is a Bad Thing, with capital letters. In litigation, both parties are obligated to preserve anything and everything that could be evidence in the trial. Intentionally destroying evidence, especially evidence that may be essential to the plaintiff's case, is a violation of procedure. In addition to potential sanctions against the attorney if the attorney was involved, the jury is instructed to effectively treat whatever evidence that was destroyed as whatever the non-destroying party said it was-- in essence, they are allowed to consider it as damning as the plaintiff here says it was.
