Sweden's limit is 0.02, and there's a huge cultural stigma against drinking then driving, even if it's just one beer. Even after 5 years in California it weirds me out that people will have a glass of wine or beer with food then drive.

True, but it's really easy to tell if it's something that doesn't affect BAC, a second test 10 minutes later will show greatly diminished values. If you drank a whole bottle of Scotch at the Senior Rates mess, and you have to get breathalyzed for duty the next day it's a pretty workable excuse, if you can run away before they try the second test. Drinking and driving is bad, but with the margin of error on breath testers I think 0.08 is pretty reasonable. We had two, one would register low values, and trip on poo poo like toothpaste and if you just spit a dip out, and would register 0.02-0.04 after a night of mild drinking, the other one prett much had a dead spot between 0.00 and 0.12, so you were safe blowing in it unless you were actively drunk.

And yes as said, a second test will easily show that was a false positive. And no, 0.05 is not low - It's resonably established that this is the point your driving becomes impaired. Frankly it's not hard to just not drink when you know you are going to be behind the wheel in a few hours anyway.

Post avatar combo incoming .05 is too low. Personally I think DUI should hinge on breathalyzer + another method like reaction time testing that is not made up bullshit like a field sobriety test. It seems like reaction time testing would be easy to implement (when you see light, press button, repeat 5x or 10x)

I'm not wading into the minefield that is BAC, but I will agree that the field sobriety test is pretty BS. Wasn't it mostly dreamed up as a way to get video evidence of a driver's lack of coordination, for jury trial? I'm pretty coordinated but I don't if I could stand on one foot on the side of the highway with traffic going by, at night, with police lights flashing in my face.

Or just leave your car at home and get a cab so you can get wrecked without fear of getting fisted by the law or just being that oval office that risks having a few and drives anyway because "I'm not drunk". We've really enjoyed our oncologist to this point, but when we first met him, he told us that the highest risk places for cancer to travel was the liver, the lungs, bones, and the brain. But he wasn't concerned about the brain and didn't think it was necessary to have a brain scan done, despite it being a high risk area. Several weeks into treatment, my girlfriend began complaining of mild vision issues that got a little worse, and have since gotten better, but they insisted it was just a side effect of the medication. She finally convinced him to get her in for a brain MRI yesterday. Guess who has lesions on the surface of her brain?

Yeah, we're pissed. We have options and we'll figure it out. To top things off, I was asking about a job interview she had in here the other day, and she was made an offer for more than she asked, better benefits than she currently has, and 3 weeks vacation plus additional time off. She has to contact them by the end of the day to accept or decline and she's not sure what to do. Also we'll probably miss our friend's Christmas party next weekend that we were both looking forward to, because she now has a lumbar puncture scheduled for next Friday. I like to swing by the beer store on the way home and get my growlers filled. Beers on tap are constantly changing so, I like to taste a few things to find out what I want before I buy them. Say I taste a half dozen beers out of the 36 taps. That's somewhere near 3oz total. It's not a significant amount, but its not nothing. Sometimes I'll order a full beer and hang out for a bit and talk beers with the staff, or meet a coworker there and chill for an hour while traffic dies down.

Drink driving is stupid and selfish and so very not AI. "well it's not drink driving because I only had a little / one / a couple / a few actually I have a high tolerance and ..." Get hosed.
