Kavanaugh would have taken up the issue, but he did not join the three others in their call to revisit that matter after the election, possibly leading to another Bush vs. Gore. Alito said outright they could take the case after the ballots are cast. Thomas and Gorsuch just kind of griped “well the GOP raised a good point and we should have taken the case earlier”. It’s not clear if they are salivating along with Alito at the prospect of flipping an election post facto.

The essential SCOTUS position makes *some* sense, but it's real iffy. - State makes the election law and that's the baseline. It's the state legislatures' job to set the rules. - If a Federal Judge recently overturned the state law, reverse the Federal Judge. State trumps Feds and too close to the election to gently caress with things (Purcell Principle). These are the Michigan/Texas rulings. - If a State Supreme Court overturned the state law and extended turn-in deadlines, leave them alone. State Supremes are allowed to gently caress with their state rules (NC/PA decisions today). The trouble is that the minority is saying gently caress YOU, CALVINBALL BECAUSE [dumb pretext]. OH BY THE WAY, WE CAN REVIEW THIS AFTER THE ELECTION BECAUSE [dumb pretext]. Also, this all flies in the face of the SCOTUS view of "gently caress you state courts, you can't review gerrymanders because [dumb pretext]". It doesn't help that Kavanaugh is dumber than a box of rusty hammers. Yes, because I know that when I'm dealing with original documents that I apparently haven't made a copy of, scanned or photographed, I just throw the one and only copy in existence in a fed ex envelope and hope for the best, and I definitely don't throw an intern on a plane to deliver it by hand.

The argument from kav et al is that the constitution specifically vests the decision making for elections in the state legislatures so no one but the state legislature has a say in how the election is run. Delegation of that authority is allowed, but interpretation of state law is apparently not because the constitution says it belongs only to the legislature. You'll notice this position is in complete contrast to the position they took on the voting rights act where the amendment specifies that congress alone has the power to enforce constitutional voting compliance.
