yeah, prosecutors love charging cfaa violations because it’s incredibly easy to make a compelling case that somebody had no legitimate reason to do a particular access. why make a hard case when you can make an easy one?

the basic legal question here is when something “exceeds authorized access”. basically, does that rope in arbitrary policy violations, like “it’s illegal do anything your aren’t supposed to do”, or is it a more basic level of “authorized”, like “don’t bypass system protections”

Are we still talking about the usual kind of encrypt-your-data ransomware? That would suggest that all of these affected orgs have bad backup and restore practices in addition to the security faults. Why not start with fixing those? It will be a lot faster than changing legislation.

I believe that's the normal type, though some modern variants also transmit a copy of the data to the gang so they can sell it or blackmail the target later.

That's a conscious and deliberate acknowledgement that not only is it difficult to plan 60 years ahead, but that new discoveries and inventions might be made.
The point was to get a binding law that would oblige the the current and future governments to work on this, so that they can't behave like like other nations have, where they all go to Copenhagen, have drinks and agree that they need to dosomething, then go home and do absolutely nothing.
