It really depends on how they are billing the client and the contract they have with them. If it is solely time and materials, then it's super fraudulent. But if it's fixed fee, then they could take 800 hours or 10 minutes but still bill that 40. It sounds more likely that it is fixed fee and the PM is trying to keep his resources at a certain utilization rate to justify something to someone.
