Yeah, this is why I tie myself into mental knots having to deal with this poo poo, because all of the below are true:

- there is zero caselaw in favor of an executive privilege review and everything against it

- the judge could just be spewing verbal diarrhea as they like to do, then rule for the government

- the judge could just be spewing verbal diarrhea as they like to do, then back it up with that action

- judges use motivated reasoning as much as political hacks, because they are political hacks in many cases

- this really is a pretty novel case because no other president has been dumb enough to keep classified poo poo

- law is fake when trump judges declare it so and there's no logic to it

I'd assume not, otherwise wouldn't supreme court justices appointed during a sitting presidents term be required to recuse themselves anytime the government is a party to case?

Probably not. Judges that are appointed by the POTUS are constantly ruling on motions on lawsuits against the POTUS's government, especially in the DC Circuit. The general idea is that a justice should recuse themselves if they feel conflicted about it, which is semi-common in Supreme Court cases. That's especially the case where the recusing justice was a previous arguing party. And an appointment to even the lowest district court is lifetime, so there's nothing an angry POTUS could do as punishment, short of not promoting them to the circuit/supreme court. Also, most of the time the criminal trial judge is chosen at random from all the district court judges, so there's very little judge-shopping, unlike civil actions.

It's all bullshit, but that's the idea anyways. Egregious poo poo could always be appealed to the higher court on an emergency motion.

:siren: OMICRON BOOSTERS ARE NOW APPROVED :siren:

quote:

Doses began shipping Wednesday to pharmacies, clinics and doctor’s offices after the FDA authorized the updated shots from Moderna and from Pfizer and its German partner, BioNTech. Like earlier coronavirus vaccines, the updated boosters will be free.

The new boosters — the first changes since the mRNA vaccines were rolled out in December 2020 — target the BA.4 and BA.5 omicron subvariants dominant in the United States. Officials say the new shots will help broaden immunity because they are a closer match to the strain that is circulating.

People can receive the updated shots if it has been at least two months since they completed their primary vaccine series or their most recent booster. Even if an individual received boosters of the original formulation, they can get the updated booster as long as it has been two months after their last shot. The interval of at least two months is intended to broaden immunity because getting shots too early reduces the vaccine’s effectiveness.

Availability is pretty poo poo right now, but is ramping up:

quote:

CDC said doses should be available within the next few days. Pfizer has already shipped more than 100,000 doses to 62 locations across the United States and expects to have 3 million doses available at more than 3,300 sites by Tuesday, the end of the Labor Day holiday weekend.

Moderna also promises to make its new booster available this month.

CDC’s Advisory Committee on Immunization Practices voted today to recommend the use of COVID‐19 booster vaccines targeting the BA.4/BA.5 Omicron subvariants, and the recommendation was approved by the director.

Limited stock has been pre‐staged at pharmacies and will be available starting next week (officially Saturday at some locations). At this point, you couldn’t get a booster of the original formulation even if you wanted one (you shouldn’t).

Everyone twelve years of age or more who has completed their primary series of the vaccine and has had their most recent COVID‐19 shot no more recently than two months ago is eligible for Pfizer’s shot. Moderna’s is only for adults.

Reactions really vary.

I got nothing but a little soreness in the arm on the first shot. Second shot made me uncomfortable but functional for thirty‐six hours (two nights, one day)—fever, aches, fatigue. Third shot was like the second but much stronger. I wasn’t bedridden, but I just felt awful.

So I was not looking forward to the fourth shot, but I got it and then… nothing. Not even a sore arm. Five months later I got a fifth and it didn’t do anything to me, either. This is with no history of infection.

That’s just my experience, though. Some people do keep having strong reactions. It will be interesting to see if my body sounds the general alarm for the new spike or if it shrugs it off like it did the last two times.

Interesting how it can vary so wildly. I got the Pfizer two dose vaccine at the beginning of the pandemic, and apart from feeling like someone had punched me in the arm for about half a day after each shot, I felt absolutely fine. The following Moderna booster and flu shot I got after that knocked me on my rear end for a whole day straight though, easily. Not sure why, maybe because I got both of them together?
