I'm always amazed that the construction actually looks really well done. It's just that in the time it took to do it, no engineer, mathematician, or frankly anyone with an ounce of sense looked at it and realized that it was a murder machine for kids.

Neighbors call the police after hearing a man screaming "I'm going to kill you," the sounds of furniture being thrown, and woman-ish screams. What they find is not a domestic violence incident, instead it's just a guy trying to kill a spider.

This is not something I did, it was my wife's niece (her sister's daughter) did. I don't know much about the law myself and have a question about what kind of consequences she is facing for what she did, because my wife is really upset right now and I don't know what to tell her. Basically what happened is that my wife's niece was in a car accident. The other driver was found at fault and was charged criminally for the accident. My wife's niece testified in court under oath about what happened. Insurance paid her claims for hospital bills and physiotherapy. She filed a lawsuit against the other driver. She also filed a report against the other driver at her work because the other driver was an off duty reserve police officer. After she testified the other driver’s dashcam came out and it proved that my wife’s niece actually caused the accident. It was all staged. There was also video from a private investigator showing my wife’s niece at the gym, going out in heels and at the beach proving she wasn’t actually hurt.
So she has been caught staging the accident, lying on the police report and in court under oath, making over $100,000 in false insurance claims, pretending to be hurt when she is not, filing a false lawsuit against the other driver and also filing a false complaint against the other driver at work because the other driver is a reserve police officer. My wife thinks nothing should happen to her niece because the dashcam video was not disclosed until after she testified under oath, so the court entrapped her into committing a crime she would have not committed otherwise. My wife also thinks the other driver probably got special treatment because she is a reserve police officer and that the prosecutor was against her niece from the start. Personally I think she deserves everything she gets for being so stupid. My wife is really upset and I just want to be able to tell her what to expect will happen to her niece. This happened 2 days after her niece turned 18 and this is the first time her niece has ever been in an accident or been in any trouble with the law. Apparently she caused the accident because she wanted money for a spring break trip which her parents were not going to pay for because they wanted her to save herself. I just want to know what, if any, charges or other consequences is she facing now that he lies have come out?

quote:

The trial I mentioned my wife's niece testifying at was the other driver's criminal trial, not the civil trial for the lawsuit. So the trial was between the other driver and the prosecutor. I don't know what the rules are for sharing evidence in this. My wife's niece didn't have a lawyer or standing for this. She was a witness. My wife thinks that the prosecutor knew about the video and decided to let her testify anyway, but I myself doubt this.
My wife's niece claimed she had the right of way because the other driver had a sign, so she she proceeded at the speed limit and was hit by the other driver who ran the sign. What she actually did was stop, wave the other driver through TWICE and then accelerated and hit the other driver. She made the same claim in her statement to police and in her lawsuit allegation. So she didn't misremember or forget a few details, she outright lied. From what I have read online and what people involved in the insurance industry have posted here this is a common way to stage an accident.
She claimed she was in so much pain that she couldn't walk and needed to be in a wheelchair whenever she went out, along with needing a neck collar and braces for other parts of her body. She even testified from her wheelchair instead of stepping up into the witness box. She was under a bed rest order from doctors except when she had to go out for medical appointments and stuff. My wife's niece claimed in her lawsuit filing that she couldn't move her foot and had numbness and partial paralysis in one arm. The investigator got her on video climbing out a back window in her townhouse and leaving the complex out the back way, going clubbing in heels and at the gym lifting weights with the hand and arm she claimed was paralysed (against the doctor's orders of being on bed rest). So even if she was hurt her actions here look bad on her. She claimed over $100,000 in expenses and from what I know at least $100,000 was paid for medical and physiotherapy bills. I could be wrong about the number she was paid but I know some was paid out.
The prosecutor is involved because this all happened around the other driver's criminal trial. My wife's niece had just filed her lawsuit right before she was found out for lying. As far as I know the other driver had answered it yet. So all the trial stuff was the other driver's criminal trial, and between the other driver and the prosecutor. It wasn't the civil trial between my wife's niece and the other driver.
I think my wife's niece is headed for prison as a felon given what she did, but I don't know anything about the law so I could be wrong.
