Apparently requiring additional arguments for the settlement isn't actually common at all, at least outside that particular judge's court. Although CNBC is also saying rejection would be surprising since the last time that happened the decision was later overturned and judges instructed to defer to the regulators.

He was the smuggest d-bag imaginable as he leverage pyramided himself up to six figure gains during the run up; but then some months ago his aggressive moves finally caught up to him and he lost like a million bucks.

You mean shorting, right? I think the reference OP brought up was actually about buying a companies credit default swap. Since these work like an insurance against that company's default, you'd see their price rack up dramatically as the company irks closer to a default. That's what eventually happened in the big short, everyone was going bankrupt and the dude's holding the insurance against that made bank.

For example bulls will argue that things like vertical integration in the Solarcity/Energy business would lead to a massive increase in revenue even though over the last
few years Solarcity has actually shrunk in terms of revenue/Cells installed and the company had a big layoff this year.
