TMM's justification here reads to me like "I want to vote this person but I don't want to be perceived as agreeing with prior cases so I need an original reason." But that reason is really weak: MMT simply voted for somebody else, rather than flip flopping to defend Tobbs or something. I just can't see that action raising enough legitimate concern to place this vote without referencing the other votes, which he seems predisposed not to do. Then that immediate hedge afterwards (in a separate post no less) screams to me that he feels like he screwed up by putting that vote out there. Plus, he follows that up with a snipe at Max for disagreeing with him, which also reads as a guilty conscience.
