Here's the thing: that's what lawsuits are for. We get to find out which aliases (if any), accounts etc they've posted under. And if the judge grants it, attorneys get to send in forensic IT people to go image all their devices, computers etc. This happens all the time; especially in legal action that revolves around stuff like this.

You also get to send subpoenas to all ISPs, social media etc for all their communications. Usually they will petition the judge to refuse it, but according to attorneys, those tend to fail quickly since judges recognize that in this digital age, most nefarious poo poo is done online.

Except that you also need a compelling reason for what you're requesting, you don't just get to say "hey man I lawsuit u, gimmie all the poo poo". If you're suing over enforcement over the TOS you'll get to ask for communications directly relating to that subject and no more, poo poo posts on reddit probably wouldn't make the cut. Also, dispatching forensic IT people is pretty rare in most litigation unless you're the fuzz. Also, you don't get anything first. In fact you wouldn't even be the one that send in the IT guys, the defendant will (you'll end up paying for it though), and even then they get to review everything before you even have a chance to see it since forensic searches turn up 99% extraneous poo poo.

That would depend on a specific cause of action in the complaint and whether or not the judge lets it stand. If there is a defamation or similar cause of action, it's all covered under cause.

I have done it twice. I know of several lawsuits in which they have been done. In fact, practically every big case you read online and in which material was disclosed, obtained this information from this sort of reveal, and not discovery (which is prone to shenanigans) whereby you ask nicely and hope they provide the material requested, don't taint the evidence etc.

I have been involved in two lawsuits between 2010 and 2012 in which we (my attorneys) filed for it, the judge granted it. Then the attorneys sent in a third-party (Asset Control, Inc) to do it. They had a judge signed sub-poena. They went to the party, got it all done etc. They billed the attorneys, who paid for it, then billed my retainer account.

The attorneys got to see it first, filtered through what they needed, then provided me (and the court) with the pertinent data.

So you're saying you got all of the defendant's data without them going though it for privilege first? You got personal info, attorney-client communication, extraneous trade secrets, etc.. and the judge was like, what's privilege, cool man, whatever.

Yes, myself or anyone can sue them over Star Citizen but as attorneys (even the two that contacted me and offered to help pro bono) have said, we run the chance of it being tossed out of State or Fed court and into arbitration due to the ToS. In my case, since they have NO evidence that I ever agreed to their new ToS, having never - ever - played the game or done anything that resulted in my agreeing to said ToS, I do have a case. But a slim one.

So the choice is either :

1) sue in State or Fed court and run the risk of it being tossed to arbitration as per Star Citizen ToS. waste of time and money. bad.

2) then (as per above) in arbitration, show enough cause to get it tossed back into State or Fed court. waste of time and money. bad. going back to #1 is good.

3) sue Chris for defamation, make RSI/CIG a party to the suit and add a litany of causes of action related to Star Citizen.

4) wait for the whole thing to collapse. now there are so many reasons (aka "Cause Of Action") to sue either in arbitration, State, Fed court because now we're talking about the collapse of a $106M+ project; which is still shy of the $150M+ collapse of 38 Studios and which reached a crescendo of legal shenanigans only because the State had $75M invested in it.

There are other options which I am not at liberty to discuss. But at the end of the day, I have always maintained that I have no intentions of giving up unless and until they 1) give people the refunds they asked for 2) they provide the financial accounting they promised

In the US, you don't need a plausible reason to sue someone. I could walk into court today, and for less than $500, sue them for a laundry list of things. They will attempt to get it tossed. And if they succeed, they can petition for their legal costs etc.

The legal system is hosed. Which is why a company like this can do shady poo poo like the ToS shenanigans - and get away with it for a long as they can.

Have you considered setting some money aside so that you can pick up some of that sweet restoration hardware furniture at their liquidation sale?

Also what's the over/under on them fleeing the country?

Thing is though they don't have to announce cutting ships. They just have to not provide any updates, just like they're doing now.

So what's the bet on how it shakes out? I'm betting they'll do the Derek and announce that the PU has been pushed back indefinitely and only work on SQ42. I wonder if any shell company shenanigans will happen and CIG USA goes under leaving Foundry 42 with the remaining cash?

Also, the 38 Studios comparison is funny because they actually managed to release a decently well reviewed game before hey went belly up.
